Rod Sessing stated he put the fieldstone along his driveway to help control erosion onto his neighbors <br />property. He received prior approval from the City's building inspector and that the complaint is coming to <br />the City a year and a half after the fact. Photos were presented. <br />Joan and Steve Ziertman stated they were not opposed to fieldstone as an element of landscape, but felt Mr. <br />Sessing has overdone it. Their home is 150' from the rocks and very visible from their house and find it <br />obtrusive. Photos were submitted. <br />Attorney Filla stated the City couldn't ignore actions taken by property owners with reliance on the city's <br />action and some of that has occurred here. The City 's landscaping ordinance doesn't include decorative <br />rock as among the things permitted; though it is commonplace throughout the City. <br />M/S/P Dunn/Armstrong — to update the landscape definition and/or ordinance allowing it to reflect the use <br />of decorative rock or fieldstone tied in with landscaping enhancement. (Motion passed 5-0). <br />M/S/P Armstrong/Siedow — to direct the staff to prepare a Findings of Fact Resolution No. 37 to uphold the <br />appeal by Rod Sessing based upon justifiable reliance by the City to proceed. (Motion passed 5-0). <br />B. Resolution placing garage closer to property line: Jim Douglass, 8001 50"' St <br />Jim Douglass, 8001 50a` Street N., requested approval by resolution to place a detached garage closer to the <br />road side propertyline than the main structure. Because of the close quarters and turnaround space for his <br />attached garage, it would be difficult to move proposed garage back. Jim McNamara, Building Official <br />stated there are no variances required and our city ordinance Section 300.13, Subd. 3-J does allow this <br />request by resolution. <br />M/S/P DeLapp/Dunn — to adopt Resolution No. 99-38, A Resolution allowing Jim Douglass, 8001 50°i <br />Street N., to place a detached garage closer to the road side propertyline than the main structure. (Motion <br />passed 5-0). <br />7. CITY ENGINEER'S REPORT: <br />A. Acceptance of Final Plat of Judith Mary Manor <br />Tom Prew, City Engineer, reported that all the construction work on the Judith Mary Manor plat is now <br />complete and acceptable and recommends acceptance and approval of this plat. The developer has planted <br />boulevard trees as required by the developer's agreement. Planting of trees on unwooded lots will be <br />completed prior to July 1, 1999. <br />M/S/P Armstrong/DeLapp to accept the Final Plat of Judith Mary Manor upon payment of all city costs and <br />submittal of record drawing to the City Engineer. (Motion passed 5-0). <br />S. PLANNING. LAND USE & ZONING: <br />A. Resolution Extending the Moratorium on the PF Zone. <br />M/S/P Dunn/DeLapp — to adopt Ordinance 9748, An Ordinance Extending the Development Moratorium <br />on property located within the Public Facility (PF) Zoning District of the City; subject to the City Council <br />be given an update as to where we are at the September 7"' Council meeting. (Motion passed 5-0). <br />B. Resolution Requesting Extension Date for Comprehensive Plan Update <br />Completion of the Update of all Metro Area local comprehensive plans was to be by December 31, 1998. <br />Because of the uncertainties related to the outcome of the Consolidation Referendum, the City requested an <br />extension of one year in December, 1998.
