ARTICLE 1: RECOGNITION <br />A. The employer recognizes the UNION as the representative of <br />all workers who are defined as public employees by Minn. Stat. <br />179A, excluding supervisory and confidential employees. <br />B. If the EMPLOYER establishes new job classes within the <br />bargaining unit, both parties agree to negotiate on wages. All <br />other terms and conditions of this AGREEMENT will apply. <br />ARTICLE 2: DEFINITIONS <br />The following words and phrases will have the meanings given here <br />and will apply throughout this policy. All other words and <br />phrases used in this policy will maintain their generally <br />accepted common meanings. <br />A. ANNIVERSARY DATE -the month and date of an employee's initial <br />hiring or promotion. <br />B. EXEMPT EMPLOYEE -employees to whom the federal Fair Labor <br />Standards Act does not apply. Generally, administrative, <br />executive and professional employees are exempt employees. <br />C. INDEPENDENT CONTRACTOR/CONSULTANT -persons or firms hired by <br />the City who determine their own hours of operation or use <br />their own resources in the performance of their duties. <br />Independent contractors and consultants are not City <br />employees. <br />E. JUST CAUSE - the term shall mean any act of misconduct on the <br />part of an employee, which will reasonably justify the <br />imposition of discipline and further justifies the penalty <br />imposed. <br />F. NON-EXEMPT EMPLOYEE -employees to whom the federal Fair Labor <br />Standards Act applies. <br />G. OVERTIME -time worked by non-exempt employees in excess of 8 <br />hours per day or forty (40) hours per week. <br />H. PART-TIME EMPLOYEE <br />1) REGULAR PART-TIME EMPLOYEE - an employee retained on a <br />non -temporary basis who works less than forty (40) <br />hours per week on a regular schedule throughout the <br />year. <br />2) NON -REGULAR PART-TIME EMPLOYEE - an employee retained <br />on a temporary basis who works less than forty (40) <br />hours per week on an irregular schedule throughout the <br />year. <br />3 <br />
