A. All non-exempt employees are eligible for overtime pay. <br />Overtime will be paid at a rate of one and one half times <br />the regular hourly rate of pay for hours worked in excess of <br />8 on any given day or each hour worked over forty (40) hours <br />in a given work week. Overtime work must have prior approval <br />by an employee's immediate supervisor or the designated <br />personnel representative except in the case of emergencies. <br />B. All paid leave time shall be considered time worked for the <br />purpose of computing overtime® <br />C. Compensatory time off may be available to non-exempt <br />employees at the City's option as an alternative to overtime <br />pay. If available, non-exempt employees are eligible for <br />compensatory time off at the rate of one and one-half hour <br />for each hour worked in excess of forty (40) hours per week. <br />Compensatory time off must be used within two (2) weeks of <br />the date or dates on which it is accrued unless permission <br />is received from the City Administrator to use it on a later <br />date® No compensatory time off is available unless the <br />employee has received approval from his or her supervisor or <br />the City Administrator before the work is performed. <br />D. Exempt employees may flex their work schedule within the <br />eighty (80) hour bi-weekly pay period provided they receive <br />supervisory approval. When an exempt employee has an <br />emergent, unanticipated work need and prefers to <br />subsequently flex the time, he/she may work the necessary <br />time without prior supervisory approval. Exempt employees <br />may earn compensatory time on an hour for hour basis for <br />hours worked in excess of eighty (80) in a bi-weekly pay <br />cycle and such time must be used within one month of accrual. <br />It is understood that the earning of compensatory time does <br />not affect or change the employee's status with regard to the <br />Federal Fair Labor Standards Act. Accumulated compensatory <br />time for exempt employees will not be paid out under any <br />circumstance. <br />ARTICLE 12: BENEFIT ELIGIBILITY <br />Only regular full-time and regular part-time employees are <br />eligible for benefits. Non -regular part-time employees, temporary <br />and seasonal employees, and independent contractors and <br />consultants are not eligible for benefits provided by the City. <br />Regular full-time employees are eligible for full benefits. <br />Regular part-time employees are eligible for holiday, vacation <br />and sick leave benefits in proportion to the hours they work per <br />week: <br />13 <br />
