Said temporary construction contains ±43 0 square feet. <br />Said temporary construction easement expires July 1, 20151 <br />2. Scope of Easements. The perpetual easement for sidewalk purposes granted herein <br />includes the right of the Grantee, its contractors, agents, and employees to locate, construct, <br />operate, maintain, alter and repair sidewalk facilities within the described easement area. As used <br />herein, "sidewalk purposes" is defined as. the use of sidewalk facilities by pedestrians, non - <br />motorized bicycles, city and public safety vehicles, and electric -powered wheelchairs and small <br />electric carts operated by physically handicapped people. The use of sidewalk facilities by <br />snowmobiles or all -terrain vehicles is not included within the scope of the easement granted <br />herein. <br />The easement granted herein also includes the right of the Grantee, its successors or <br />assigns, to cut, trim, or remove from the easement areas trees, shrubs, or other vegetation as in <br />the Grantee's judgment unreasonably interfere with the easements or facilities of the Grantee <br />located therein. <br />The Grantors do hereby release the city of Lauderdale from any claims for damages to <br />the fair market value of the above-described areas covered by these easements and for its use, or <br />any claims for damages to the fair market value of the remaining Property of Grantors caused by <br />the use'of these easements, including grading and removal of materials from said easement areas <br />for sidewalk purposes. <br />IN Title. 3. Warranty of i tle. The Grantors warrant they are the owners of the Property and have the <br />right, title and capacity to convey to the Grantee the easements herein. <br />4. Environmental Matters. The Grantee shall not be responsible for any costs, expenses, <br />damages, demands, obligations, including penalties and reasonable attorney's fees, or losses <br />resulting from any claims, actions, suits or proceedings based upon a release or threat of release <br />of 'any hazardous substances, pollutants, or contaminants which may have existed on, or which <br />relate to, the easement areas or Property prior to the date of this instrument. <br />1 <br />5. Binding Effect.
