CITY OF LAUDERDALE <br />PMENDED AND RESTATED AGREEMENT FOR RECYCUNG SERVICES <br />This Amended and Restated Agreement for Recycling Services (the "Agreement") is made as of <br />this 23rd day of September, 2014 between the City of Lauderdale (thereafter the "City") and <br />Neighborhood Recycling Corporation DBA Eureka Recycling (thereafter the "Contractor"), a <br />Minnesota non-profit organization. <br />Whereas, the City and the Contractor entered into an agreement for recycling services as of <br />January 1, 2005, which agreement has been amended subsequently, and <br />Whereas, the City and the Contractor wish to amend and restate said agreement. <br />1 DEFINITIONS . <br />These specifications define the requirements of the Comprehensive recycling Collection <br />Program for the City: <br />1.1 Carton -Any of various containers made from cardboard or coated paper such as milk cartons and <br />juice boxes. <br />1.2 Cerfified Dwelling Unit (CDU) — Defined as a living unit in a residential structure. <br />1.3 Collection District — Defined as a specific geographic area of the City established for the purpose of <br />having recycling collection for all CDUs and other City designated recycling. collection stops in the <br />district on the same day. <br />1.4 Collection Hours — Defined as the time period during which collection, of recyclables is authorized in <br />the City, 7 a.m. — 6 p.m. <br />1.5 Collection VehiGle — Defined as any vehicle owned or operated by the Contractor for collection of <br />recyclables, within the corporate boundaries of the City. <br />1.6 Contractor — Means the company performing the recycling collection and processing services within <br />the City, operating under a signed agreement with the City. <br />1.7 Curbside — Means near the edge of the public or private street from which the CDU gains its access. <br />1.8 Curbside Recycling Carts -Wheeled carts used as part of a single-sorts#� collection system. <br />1.9 Holidays — Means the following: New Year's Day, Memorial Day, Independence Day, Labor Day, <br />Thanksgiving Day, and Christmas Day. <br />1.10 Market Demand — Means the economic and technical capacity of markets to use recyclable <br />material to make new products. <br />PAGE 1 OF 13 <br />
