<br />. <br /> <br />Subd. 3. "Park" means any area designed or used for active or <br />passive recreation and which is owned, operated or controlled by the City or <br />controlled by another government unit. <br /> <br />Subd. 4. "Director" means and refers to the director of parks and <br />recreation - that person authorized by the Mounds View City Council to direct the <br />department of parks and recreation. <br /> <br />Subd. 5. "Department" means and refers to the City of Mounds View <br />Parks and Recreation Department. <br /> <br />Subd. 6. "Open space waters" means any public shoreline owned by <br />or under the authority of the City of Mounds View. <br /> <br />Subd. 7. "Law enforcement officer" means and refers to any person <br />duly deputized or commissioned by the City of Mounds View, Board of Ramsey <br />County Commissioners or the State of Minnesota for the purpose of enforcing the <br />laws, ordinances and regulations of their respective jurisdictions. <br /> <br />. <br /> <br />Subd. 8. "Motor vehicle" means every vehicle which is self-propelled <br />and does not derive its power from overhead wires. Motor vehicles include, but <br />shall not be limited to automobiles, trucks, motor bikes, mini bikes, all-terrain <br />vehicles and snowmobiles - with the exception of battery powered wheelchairs. <br /> <br />908.03 CONSTRUCTION AND SCOPE. In the interpretation of <br />this chapter, all provisions contained are to be construed as follows: <br /> <br />Subd. 1. Any requirement or prohibition by any provision extends to <br />and includes the causing, procuring, aiding or abetting directly or indirectly, of <br />such acts; and the permitting or allowing any minor by the responsible parent, <br />guardian, or custodian to commit any such act. <br /> <br />Subd. 2. No provision shall make unlawful any act necessarily <br />performed by any law enforcement officer or department employee in the line of <br />duty or work as such, or by any person, his agents or employees, in the proper <br />and necessary execution of the terms of any contract or agreement with the City <br />of Mounds View. <br /> <br />Subd. 3. Any act otherwise prohibited by statute or local ordinances, <br />is lawful if performed under, by virtue of and strictly within the provisions of a <br />department permit to do so, and to the extent authorized thereby. <br /> <br />908.04 <br /> <br />HOURS AND ACCESS <br /> <br />. <br /> <br />Subd. 1. The recreation and education opportunities of the system are <br />available to all members of the public regardless of race, sex, age, creed, national <br />origin or place of residency. <br /> <br />2 <br />
