<br />3. '.Special Requirements When Rear
<br />Yard mcludes Loading' Area:' Where a'rear
<br />yard of a shopping center district Includes
<br />1= . the loading and servicing area of a shopping
<br />center building and where such a rear yard Is
<br />adjacent or across the street from a residen-
<br />tisl district, the building setback shall be one
<br />hundred twenty feet (120'), and the buffer
<br />strip s~all be sixty feet (60'). (Ord. 275, 5-12-

<br />A.' Floor Area Ratio: Ratio between floor
<br />e area of building and lot area shall not be
<br />g . greater than 0.5.
<br />B. lot c:overage: Not more than, twenty
<br />five percent (25%) of the lot area shall be
<br />occupied by buildings.
<br />C. Building Height: Building height shall
<br />be limited to three (3) stories where a base-

<br />reasonable effort must be made to design

<br />shall also provide pedestrian access routes
<br />using walks or paths, Including where practi-
<br />cal, connections to adjacent residential
<br />areas.
<br />Service vehicles over one ton capacity
<br />which enter or exit the site between the
<br />hours of 10:00 p.m_ and 7:00 a.m.. shall use
<br />a designated routeE!Pproved by the City.
<br />Deliveries and/or delivery truck access, in
<br />and on the site during the hours of 10:00
<br />p.m. to 7:00 a.m., shall be limited to single
<br />unit, two axle vehicles not in excess of
<br />26,000 pounds gross weight. The designated
<br />route shall keep vehicles at least 300' away
<br />from any residential district boundary, or be
<br />completely screened by a building, wall,
<br />landscaped berm, fence, or Comblnjition
<br />thereof from a point 14' above the ground at
<br />the outside edge of the truck route lane 10 a
<br />point 5' above the first floor (main level) of
<br />the'adjacent residences.
<br />F. Off-Street Parking: Off-street parking
<br />requirements shall be as listed in subsection
<br />1005.010, and in addition:
<br />1. Twenty-four (24) hour uses within .
<br />300 feet of a residential district shall provide
<br />screening of parking and driving areas adja-
<br />cent to residential areas. The screening,
<br />which must have a minimum opacity of 90%
<br />year round and a minimum height of six (6)
<br />feet, may be provided by landscaping, walls,
<br />fences, berms, or combinations thereof.

<br />within 300' of light source. All lights not rea-
<br />sonably required for security or business
<br />operation must be turned off between the
<br />hours of 10:00 p.m. and sunrise, or operated
<br />by motion detectors so that they only tum on
<br />when there is activity. nearby and turn off
<br />shortly thereafter.
<br />J. Other Requirements:
<br />1. Certain Businesses in Shopping
<br />Center Districts to, be Enclosed: All business,
<br />storage, service, repair or processing,' box
<br />and crate storage or merchandise display
<br />shall be conducted wholly within an enclosed
<br />building or behind a solid fence not less than
<br />five feet (5') high except as allowed in sub-
<br />section l005.01G. (Ord. 1066, 7-24-89)
<br />2. COmmunication: All uses within the
<br />. .S-~" dis~rict shall have, and must post on
<br />the exterior premises, a phone number that
<br />will be answered by persons with authority,
<br />including the shopping center manager and
<br />the individual store manager, 10 respond to
<br />customer concerns or complaints during
<br />business hours or when other related com-
<br />mercial activities occur.
<br />3. Security: Commercial property own-
<br />ers will be responsible for providing frequent
<br />and thorough security monitoring of commer-
<br />cial areas within 300' of a residential district.
<br />4. Site Maintenance: Coinmercial prop-
<br />erty owners shall be responsible for daily site
<br />monitoring and !lite malntenance,including
<br />trash pickup In parking areas bordering resi-
<br />dential areas.
<br />SECTION 3. Section loo8.098.1.of the
<br />Roseville City Code is amended to as fol-
<br />lows: .
<br />1. Any minor extensions, alterations or
<br />modifications of propOsed or existing build-
<br />ings or structures may be authorized by the
<br />Dev910pment Review Committee if they are
<br />consistent with the purposes and intent of
<br />the final plan. No change authorized by this
<br />Section may Increase the qube of any build-
<br />ing or structure, the number of required
<br />access points, or parking spaces by more
<br />than ten percent (10%).
<br />SECTION 4. Section 1013.01 of the
<br />Rosevllle City Code is amended to add a
<br />paragraph H. to read as follows:
<br />H. Any owner of land who has received
<br />a cOnditional use permit may apply for an
<br />amendment to the conditional use permit.
<br />Applications for amendment or modifications
<br />shall be processed as original applications
<br />except that minor modifications to the terms
<br />and conditions of the permit that do not
<br />exceed a ten percent (10%) departure from
<br />the standard or condition specified in the
<br />permit may be approved upon application to
<br />the Community Development Director, after
<br />the review by the Oevelopment Review
<br />Committee (DRC). .
<br />SFCT10N 5. Effective Date. This ordi-
<br />nance shall take effect on Jimuary 1,2000.
<br />following its passage and publication.
