Resolution 7415 <br />Page 2 <br />WHEREAS, on September 22, 2008 the City Council adopted <br />Resolution 7338 approving the policy to address non-conforming driveways <br />within the Street and Utility Improvement Program; and <br />WHEREAS, on December 22, 2008 the City Council adopted <br />Resolution 7382 approving the plans and specifications, setting the bid date, and <br />authorizing the advertisement for bids for the 2009-2010 Street and Utility <br />Improvement Project; and <br />WHEREAS, pursuant to Resolution No. 7382 sealed bids were <br />received on January 29, 2009, at 2:00 P.M. for the 2009-2010 Street and Utility <br />Improvement Project; and <br />WHEREAS, on February 23, 2009 the City Council adopted <br />Resolution 7414 awarding a construction contract for the 2009-2010 Street and <br />Utility Improvement Project; and <br />WHEREAS, through the course of developing the 2009-2010 Street <br />and Utility Improvement Project it became apparent that the opportunity existed <br />to incorporate certain private improvements with the public improvements to be <br />performed; and <br />WHEREAS, it is recognized that efficiency, economy, and <br />protection of the public infrastructure is enhanced if those certain private <br />improvements are performed under the public contract for the projects within the <br />Street and Utility Improvement Program. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Mounds View, Ramsey County, Minnesota as follows: <br />A limited amount of private improvements within the public <br />right-of-way will be allowed as part of the construction contracts <br />under the Street and Utility Improvement Program. <br />2. A signed Agreement between the City and the Property Owner is <br />required for any private improvements to be performed. The signed <br />Agreement must be in place prior to construction of the <br />improvements. <br />
