Mounds View City Council March 22, 2010 <br />Regular Meeting Page 11 <br />• City Administrator Ericson advised that the City of Arden Hills was holding a TCAAP meeting <br />on April 14, 2010. He noted that there would be a quorum of the Mounds View Council present <br />at this meeting. <br />City Administrator Ericson reported the Community Center received a request for having alcohol <br />at an event without a licensed caterer, provided the alcohol is not for sale. He explained <br />Minnesota State Statutes were changed last year to provide for this situation. Liability issues and <br />insurance were still concerns, but this has been discussed with the City Attorney. An additional <br />waiver would be signed by the party to hold the City harmless. He questioned how the Council <br />would like Staff to proceed with this request. <br />Council Member Mueller asked who would cover the insurance and how the event would <br />monitor serving to minors. She suggested the contract stand as is and not allow for alcohol <br />service without a caterer. <br />Mayor Flaherty questioned if the City could have a hold harmless clause. City Attorney Riggs <br />stated this could be added to the contract but any event could pull the City into a legal suit. City <br />Administrator Ericson added that the League of Minnesota Cities does offer an extra insurance <br />policy for the City for these types of events. <br />Council Member Stigney stated he was not in favor of changing the current contract as it would <br />• bring about too many new concerns for the City to address. <br />Council Member Mueller indicated the Community Center was well used and she did not feel it <br />was the time to make a change. This issue could be readdressed in the future. <br />Council Member Hull asked what policies were followed by 5horeview and New Brighton. City <br />Administrator Ericson stated New Brighton and Shoreview had speciiic city approved caterers <br />that could be used for events. There was not an option to bring in open events with alcohol. <br />Mayor Flaherty thanked the Council for the discussion on this item. He did not feel it was <br />necessary to move forward with this item as it brought on unnecessary liability to the City. <br />City Administrator Ericson reviewed the April Work Session agenda with the Council. <br />City Administrator Ericson presented the Council with information on a small parcel of land <br />owned by the City adjacent to the Townsedge manufactured home park. He indicated this parcel <br />used to be a water tower site. In 1994, Wolf & Associates requested use of the parcel to expand <br />their facility, which was never completed per City's recommendations. De1lComm has since <br />acquired the property and uses the city's parcel for storage. <br />City Administrator Ericson requested feedback from Council on how to proceed with this parcel. <br />He noted the City could require De1lComm to vacate the site or could enter into a lease <br />• agreement for a reasonable amount. The lease agreement would pass the t�es along to <br />DellComm as well. <br />
