Mounds View City Council June 25, 2007 <br />Regular Meeting Page 6 <br />1 • <br />2 Council Member Flaherty said that he was hoping that closing off the interior access points <br />3 would resolve this issue. He then said that he would like to see some kind of separation from the <br />4 residence and the liquor store. He further suggested considering another circuit breaker. <br />5 <br />6 Mr. Waste indicated it would be almost impossible andlor very expensive. <br />~ <br />8 Council Member Flaherty asked if Mr. Waste's brother has the code, key, or access to the liquor <br />9 store. <br />10 <br />11 Mayor Marty said that this was not a one time occurrence at the property and it was advertised to <br />12 occur again. <br />13 <br />14 MOTION/SECOND: Stigney/Mueller. To Waive the Reading and Approve Resolution ?092, <br />15 Off Sale Intoxicating Liquor License for Vino and Stogies Located at 2345 County Road H2 as <br />16 Amended to Remove Item 1. <br />17 <br />18 Council Member Stigney said that Mr. Waste is aware that any further issues at the premise <br />19 address could result in a revocation. <br />20 <br />21 Mayor Marty read Condition 1 which is that no further illegal conduct at the structure in which <br />22 the licensed premise is located, and Condition 2 further investigation by the City shall continue <br />23 as to any other illegal activities at the licensed premise. • <br />24 <br />25 Council Member Flaherty said that he is willing to go along with this but he would like the Chief <br />26 to go in and verify the locks and access. <br />27 <br />28 Mr. Waste agreed. <br />29 <br />3o Mayor Marty asked whether it has been verified that the interior door to the common space is <br />31 alarmed. <br />32 <br />33 Mr. Waste indicated that the three doors are all on the alarm system. <br />34 <br />35 Council Member Mueller said that people have really been following this situation. She then <br />36 said that there is a lot of interest in this stozy. She further said that the establishment has past its <br />37 compliance checks and she is glad of that. <br />38 <br />39 Council Member Mueller indicated that she is a landlord as well and it is difficult to control what <br />4o the occupant is doing in their private space. She then said that one thing she asked about was <br />41 whether there was a way to prove the space is secured and she is thankful for the alarm <br />42 information. <br />43 <br />44 David Jahnke said that she (Council Member Mueller) works for a competitor of that liquor store • <br />45 and he would like a legal opinion as to whether this would be a conflict for her. <br />
