-3- <br />A question of interpretation developed between Attorney Meyers and Mr. Edes. <br />Mr. Edes felt that since the Rice Creek Watershed District has required a <br />dedication in excess of 10% of his property for holding pond purposes that <br />he has met the Village ordinance requirements. Attorney Meyers disagreed. <br />MSP (Neisen Pickar) To schedule a special meeting with the Village Council, <br />Park Commission, Planning Commission and Attorney Meyers for November 20, <br />1973 at 6:30 P.M., regarding cash or land dedication in proposed subdivision. 5 Ayes <br />The Rice Creek Watershed District is to be invited to the meeting also. <br />MSP (Johnson- Hodges) To recess the regular meeting at 8:59 P.M. 5 Ayes <br />Mayor Neisen called the continued drainage hearing on Sherwood Road and <br />Jackson Drive to order at 8:59 P.M. <br />Attorney Meyers read a letter of correspondence from Arvid Birkeland's <br />attorney in which Mr. Birkeland agreed to a $525.00 assessment on Lot 10 <br />if no other lot in the Birkeland Addition except Lot 7 is assessed. <br />After entertaining a few comments from the floor the Council decided the <br />following: <br />MSP (Johnson Pickar) To table the request for a drainage improvement in <br />the aforementioned area until next summer in which preceeding time some <br />sight inspections will be made, and providing that during the continued <br />months Attorney Meyers be instructed to continue negotiations with Arvid <br />Birkeland's attorney. <br />MSP (Baumgartner- Hodges) To adjourn the hearing at 9:26 P.M. <br />Councilman Johnson's Report <br />4 Ayes <br />Neisen Naye <br />Councilman Johnson asked Attorney Meyers whether the lawsuit with several sewer <br />pipe manufacturers has been settled. Attorney Meyers noted that some smaller <br />settlements have been reached, but most of the larger ones are still under <br />consideration. <br />The Council directed Clerk- Administrator Zylia to begin gathering information <br />on parking and garage requirements for new construction of multiple dwellings. <br />In addition Councilman Johnson requested an investigation into what type of <br />ordinance other communities have, if any, limiting the parking of commercial <br />vehicles in residential areas. <br />Councilman Baumgartner's Report <br />Councilman Baumgartner read the Recreation Commission minutes of October 25, <br />1973, and the Planning Commission minutes of October 24, 1973. <br />5 Ayes <br />
