Ziebarth <br />moved the adoption of Resolution 1070 Con- <br />tract for Services by Mark Hurd Aerial <br />Surveyors, Inc., to provide the City with <br />aerial photographs, rectify half section <br />map and 2 foot contours of the City. <br />Forslund seconded the motion. <br />The motion carried. <br />4 ayes <br />0 nays <br />At this point the Acting Mayor noted that 8. CODE AMENDMENT 40.06 <br />a public hearing was scheduled at 8:40 <br />and suggested to the Council that the pub- <br />lic hearing be called to order. Acting <br />Mayor Hodges called the meeting to order <br />6 at 7:55 for the purposes of having the <br />first reading of the proposed amendment <br />to the City's Chapter 40 of the Municipal <br />Code. Nelson explained that under the pro- <br />visions of the charter that no amendment <br />or ordinance could be adopted except for <br />emergency ones without having at least two <br />readings before the public and 14 days be- <br />tween the two Council Meetings before appro- <br />val. The City Attorney said that because <br />this particular code that was Land Use, a <br />public hearing was mandatory under the <br />Minn. Statute 462. Nelson read the proposed <br />amendments to the public of Chapter 40 <br />Municipal Code. There were several concerns <br />expressed by the public over the potential <br />impact of this proposal.
