MOUNDS VIEW CITY COUNCIL Page 9 Meyers next brought up a question over the Forder- Trucker project concerning assessments be a portion on t heir properties. He cautioned the City Council on the apportionment, r ut noted that it was legal and proper or apportionment to occur. No other action was taken regarding this matter. He also indicated that the Forder and Trucker Developers felt that they over- built the line and wanted the City to assist them in recapturing of the costs they felt they spent in overbuilding the system. Mr. Meyers noted that the City could do very little to assist them in recapturing some of these costs from other buyers. The Attorney wanted it noted for the official record that the City had received a settlement on the Wallard Walijarvi casein the amount of $23,000.00. He went on to say that there was still one outstanding claim to be settled in the amount of approxi- mately $2,000.00. Finally he noted that the City Treasurer should be aware that the settlement contained a repay- ment clause to the Architect. The Mayor introduced proposed Ordinance 295 creating proposed Chapter 26 obtaining the City's Rules Regulations on Public Improvements and Assessments. City had considerable discussion over Article 26.09. Council requested no amendments be made to the proposal at this time. McCarty moved that Feb. 25th be considered the first reading of the proposed improvement Chapter #26 and that the City dispense with the reading of the proposed Ordi- nance pursuant to the provisions found under the City Charter 3.05 and set the second hearing to be March 10, 1980.
