MOUNDS VIEW CITY COUNCIL Regular Meeting <br />Page 4 March 10, 1980 <br />The Mayor presented the rational behind <br />the Charter Commissions suggested language. <br />After hearing the reasons behind the <br />suggestions, the City Attorney felt that <br />the language did not contribute to the <br />clarifications of that section. The <br />Attorney stated that the suggested <br />language proposed to go back to the <br />original language submitted to the City <br />Council by the Attorney. After much <br />deliberation by the Council, with comments <br />from the public, it became apparent that <br />the original language would be substituted <br />and incorporated into the final document. <br />Rowley moved adoption of Chapter 26 with <br />the amended language found in the Proposed <br />Ordnance No. 26 in Sub Division 26.09 to <br />read as follows: <br />The City may subsequently reimburse <br />itself for all or any of the portion <br />of the cost of a water, storm sewer, <br />or sanitary sewer improvement so paid <br />by levying additional assessments <br />upon any properties abutting on but <br />not previously assessed for the <br />improvement, on notice and hearing <br />as provided for assessments '_nitially <br />made. <br />Forslund seconded the motion. McCarty moved <br />to amend the motion by adding the following <br />language at the end of 26.09: <br />The provisions of 26.09 shall apply <br />to such extensions or improvements <br />in the same manner as if they were <br />new improvements. <br />It was seconded by Ziebarth. The Mayor <br />called for the question. <br />5 ayes <br />Amendment Carried. 0 nays <br />The main motion wa_ called for and a <br />voiced roll -call vote was taken. <br />Mayor McCarty aye <br />Councilman Ziebarth aye <br />Councilman Hodges aye <br />Councilman Rowley aye <br />Councilman Forslund aye <br />The Council thus adopted Ordinance 95 /Chapter <br />26 of the Municipal Code. Nilson stated that <br />due to the language amendment the Council <br />adopted the Ordnance would not appear in <br />the upcoming addition of the New Brighton <br />Bulletin. <br />
