Mounds View City Council June 8, 1981 <br />Regular Meeting Page 8 <br />from R -1 to R -2 and to draft a development <br />agreement with a resolution of approval for the <br />subdivision and development. <br />Mayor McCarty closed the public hearing and <br />reopened the regular meeting at 9:40 PM. <br />Motion /Second: Hodges /Blanchard to direct <br />Staff to draft an ordinance for approval of <br />rezoning from R -1 to R -2 and draft a <br />development agreement with Resolution No <br />14 -81, of approval for the subdivision and <br />development. <br />5 ayes 0 nays <br />Mayor McCarty explained that each Council <br />member had thoroughly examined all material <br />relative to the issue. <br />Motion /Second: McCarty /Doty that the <br />restaurant and liquor licenses for the <br />Launching Pad, in the name of Albert J. <br />Hartinger (Launching Pad) not be renewed for <br />July 1, 1981 for the following reasons. <br />Police and inspection reports that have been <br />reviewed by the Council indicate: 1. Complaints <br />of liquor being served to minors. 2. Repeated <br />acts that violate the provisions and spirit of <br />Chapter 100 of the Municipal Code, and parti- <br />cular 100.08 Section 16. 3. Repeated viola- <br />tions of the City's electrical, building, and <br />fire codes, notably the continuing violations <br />as cited in the Staff memo of 6/8/81. 4. Viola- <br />tions of the State health code. 5. Lack of <br />cooperation with the City, for example, when two <br />minor patrons were burned in an accident on the <br />Launching Pad premises, medical attention was <br />delayed by the proprietors or their employees <br />reluctance to call the Police Department. <br />6. Other activities that have occurred on the <br />premises and on file with the City indicate a <br />danger to the public health, safety, and welfare <br />of the citizens of the City and the patrons of <br />the Launching Pad. The Council members reported <br />they had reviewed all of the filed reports related <br />to the operations of the Launching Pad. <br />5 ayes 0 nays <br />Clerk/Administrator Pauley stated that a <br />petition for referendum relative to Ordi- <br />nance No. 303 was filed on June 3, 1981, <br />consisting of 253 pages and 1215 signatures <br />and is in compliance with the requirements of <br />Chapter 5 of the Home Rule Charter. <br />Mayor McCarty recommended that the Park bond <br />be put on the same ballot. <br />14. <br />Motion Carried <br />Consideration of <br />Renewal of Launching <br />Pad Intoxicating <br />Liquor and Restaurant <br />Licenses <br />Motion Carried <br />15.
