Mounds View City Council August 9, 1982 <br />Regular Meeting Page Two <br />Motion /Second: Doty /Blanchard to approve Reso- <br />lution No. 1474, as corrected, and waive the <br />reading. <br />5 ayes 0 nays <br />The Council requested the Festivities Commission <br />be invited to attend the next regular meeting, <br />where they could be thanked personally for a job <br />well done. <br />Mayor McCarty closed the regular meeting and opened <br />the public hearing for the Fairchild Avenue right <br />of -way vacation at 7:41 PM. <br />Director Johnson summarized the request for the <br />vacation of Fairchild Avenue. <br />Mr. Werner stated he was not in favor of having <br />the road developed. <br />Peg Mountin, Chairman of the Planning Commission, <br />reported the Planning Commission was recommending <br />the City retain the right -of -way so as not to pre- <br />clude development of the two southern parcels of <br />land, as well as potentially develop the bike and <br />foot path. <br />Sue Gale, 8227 Groveland Road, stated she felt <br />the City had given a verbal agreement earlier to <br />put a road through. Mayor McCarty replied that <br />that agreement was for a cul -de -sac. <br />Deb Yost, 8205 Groveland Road, asked why a one year <br />time limit had been placed on putting a road in. <br />Mayor McCarty replied the reason for the timing is that the <br />benefited landowners could petition for a road improvement <br />thereby showing their good faith for their request and to <br />alleviate the garbage control problems collecting on the lot. <br />He explained the City has been petitioned to have the area <br />vacated, so must take some action to either vacate it or develop it. <br />There was considerable discussion regarding liabil- <br />ity if someone were to be injured on the property, <br />the feasibility of putting through a walk -way, the <br />difference between a dedicated right -of -way and ease- <br />ment, why the City had cleaned up the rroperty earlier, <br />and why a variance for a 60' lot could not be granted. <br />Mayor McCarty closed the public hearing and reopene-' <br />the regular meeting ac 7:59 PM. <br />Motion /Second: Doty /Hodges to approve Resolution <br />No. 1469 as amended, and waive the reading of the <br />resolution. <br />5 ayes <br />Motion Carried <br />6.
