Mounds View City Council February 13, 19P4 <br />Regular Meeting Page Theee <br />Motion /Second: McCarty /Linke to approve the appoint- <br />ment of Mr. Michael Lauterbach and Mrs. Betty Johnson <br />to two year terms and Mr. Peter Sargent to a three <br />year term on the Planning Commission. <br />5 ayes 0 nays <br />Regarding Item H, Mayor McCarty stated he had no <br />problem with returning the security but questioned <br />why interest should be paid, as the applicant was <br />responsible to see that he received his fee back, <br />and questioned whether the City should be respon- <br />sible for seeking out applicants, as they are <br />aware the City is holding their security. <br />Motion /Second: McCarty /Doty to approve Resolution <br />No. 1713, and waive the reading, and amend the last <br />paragraph to read "Now, therefore, be it resolved <br />that the City Council of the City of Mounds View <br />authorizes the release of the $1,000 security to <br />John Mezzenga. <br />5 ayes 0 nays <br />Motion /Second: McCarty /Doty to reappoint Dick <br />Paradise to the Civil Service Commission for a <br />three year term. <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br />Mayor McCarty <br />Hankner nay <br />Blanchard nay <br />Doty aye <br />Linke nay <br />aye <br />There was considerable discussion that took place <br />before the vote on the previous motion. <br />Mayor McCarty advised Councilmember Blanchard that <br />he would allow her to abstain from the vote as her <br />husband is on the Civil Service Commission, and he <br />did not wish to place her in a position of having <br />a conflict of interest. <br />Councilmember Blanchard stated she personally did <br />not feel she had a conflict of interest, and that <br />if Mayor McCarty had felt it would be a conflict <br />of interest on the part of the Council, he should <br />not have made the appointment of her husband. She <br />pointed out that she had abstained on the vote when <br />her husband was appointed, and asked for the opinion <br />of the attorney as to whether this would be a conflict <br />of interest. <br />Attorney Rushton advised that in reviewing the ordinance <br />and State law, a conflict of interest would have to <br />be monetary, and that as long as no money is involved, <br />Motion Carried <br />Motion Carried <br />Motion Failed <br />
