Mounds View City Council April 14, 1986 <br />Regular Meeting Page Two <br />ayor Linke closed the regular meeting and opened the <br />Text public hearing at 7:12 PM. <br />Clerk /Administrator Pauley reported that at the April <br />7, 1986 agenda meeting the Council had rec -'ived <br />numerous documents relating to the request for transfer <br />of the intoxicating liquor license for Loose Ends on <br />10, and that all documents required by the City have <br />been provided, and the Police Department has found <br />no indication of any background problems of either <br />of the applicants, Steve Hauck or David Arone <br />and everything appears to be in order. <br />Richard Povlitzki, 7762 Lakeview Lane, stated he is <br />the owner of the building and he was not notified <br />until recently the business was being sold, and he <br />has the right to approve or disapprove of any sale, <br />under the terms of his agreement with Mr. Loosen, <br />and while his attorney has advised him the building <br />is being leased, rather than sold, he would like <br />further time to look into it. <br />Mr. Hauck stated he and his partner are purchasing <br />the business and leasing the building from Mr. Loosen. <br />:Mayor Linke reminded everyone the Council is dealing <br />only with the liquor license transfer issue, and <br />''they could recommend transfer of the license contingent <br />upon the final sale. <br />Attorney Meyers stated he does not know what Mr. <br />Povlitzki's interest is in the property, and the <br />issue before the Council is the application for the <br />transfer of the liquor license, and they should rule <br />on that only. <br />Mr. Povlitzki stated his attorney is questioning the <br />terms of the lease agreement between the applicants <br />and Mr. Loosen, and he feels the terms and fee for <br />leasing the building are exorbitant. <br />Councilmember Hankner asked if Staff has reviewed the <br />purchase agreement to determine if everything is in <br />order. <br />Attorney Meyers replied the City looks at the agreements <br />to insure that the parties involved have a legal interest <br />in the property, but they do not question the terms or <br />amounts specified. <br />Mr. Loosen stated the transfer of the license is urgent <br />:s they have people lined up to come in tomorrow to <br />sinventory the business, and they have loan commitments <br />which have to be met. He added that Mr. Povlitzki had <br />told him last Thursday that he had no problem with <br />this. He explained the purchase agreement between he <br />5B.
