Community Development Director Roberts stated this was the case, with <br /> additional engineering and attorneys fees paid for by the applicant. <br /> MOTION /SECOND: Mueller Stigney. To Waive the First Reading and Introduce Ordinance <br /> 855, an Ordinance Amending Appendix E of the Municipal Code about Planning Development <br /> Fees. <br /> Ayes 5 Nays 0 Motion carried. <br /> C. Resolution 7701, Approving the Mounds View Data Practices Policy and <br /> Procedures. <br /> City Administrator Ericson explained this item was back before the Council for approval after <br /> being discussed by Council at the November work session. He indicated the data practices policy <br /> provided detail as to how public and private data should be handled by the City. After numerous <br /> legislative changes, the City's policy needed revisions. <br /> City Attorney Riggs indicated the intent of the document was to dispute how public data would <br /> be handled by the City in a more user friendly manner. He explained the State had guiding <br /> policies as well. The document before the Council this evening was being used by other <br /> communities and he recommended the Council proceed with approval. <br /> Mayor Flaherty stated the policy refers greatly to Minnesota State Statute and asked if this was <br /> cause for concern. City Attorney Riggs indicated the City's policy was much more user friendly <br /> than State Statute and provided the necessary information to the public on how data practices <br /> would be handled in an efficient manner by City staff. <br /> Council Member Mueller questioned if there was a statute of limitations with data practices. <br /> City Attorney Riggs explained this was referenced on Page 12. However, the Records Retention <br /> Schedule would address this in further detail. This document would dovetail into the data <br /> practices policy and procedures. <br /> Council Member Stigney asked where emails are discussed. City Attorney Riggs indicated daily <br /> emails discussing information regarding public meetings or agendas are public information. He <br /> stated unless strictly specified, emails are public information. There was nothing written <br /> expressly into the policy, but private data policies would be applied if the issue came into <br /> attorney /client privileges. City Administrator Ericson reviewed the item further with the <br /> Council. <br /> Council Member Mueller questioned if the past bids for the street improvement projects were <br /> public information.
