Planning Commission Resolution 478-96 <br />October 2, I996 <br />Page 2 <br />WHEREAS, the variance rec�uested is the minimum variance which would alleviate the <br />hardship in that the existing residence is located 22 feet from the rear property lir�e, and the <br />applicani is requesting to replace an existing 12 %ot wide deck with the three season porch, <br />which will aiso be 12 feet wide. This width is the minimum amount needed to allo�v the porch to <br />be fi.inctional. <br />V4THEREAS, the variance would not be maierially detrimental Yo the purpose of this Titie <br />or to other property in the same zone in that the porch will be locaied in an area which is at least <br />60 feet from the nearest side properiy iine, and is at the opposite end of the common property Iine <br />shared with the neighbor to the north, from the locaiion of the northern neighbor's hause. The <br />porch will be screened from ihe northern neighbor's property by trees, <br />V�IHEREAS, the proposed variance wiil not impair an adequate supply of light and air ta <br />adjacent property or substantially increase the congestion of the public streets ar increase the <br />danger of fire or endanger the public safety or substantially diminish or impair praperty values <br />within the neighborhood in that there is adequate screening and distance between the porch and <br />adjacent residences. <br />NOW, THEREF4RE, BE IT RESOLVED, that the Mounds View Pianning Commission <br />? acting as the Board of Adjustment and Appeals approves the variance request of Ronald L. <br />Gardner for a reduction in the rear setbaek requirement from 30 feet to 14 :Feet for construction of <br />a three season porch at 84$Q Pleasant View Drive. <br />Ado�ted this Znd day of October, 1996. <br />ATTEST <br />Jerry Peterson, Chairman <br />Pamela Sheldon, - <br />Community Development Director <br />
