<br />WHEREAS, the Mounds View Planning Commission has reviewed Yhe request of Ronald
<br />L. Gardner to ailow a 10 foat rear setback w�ere 30 feet is required for the consiruction of a
<br />three season porch at �480 Pleasant View Drive; and,
<br />WHEREAS, this property is in the R-1 single family residentiai district and is located on a
<br />cui-de-sac which causes the lot to be irregular in shape; and,
<br />V�HEREAS, the Plaruaing Commission has reviewed the criteria used to evaIuate variar�ce
<br />requests; and, .
<br />WHEREAS, the appiicant presented a hardship statement to the Piannir�g Commission
<br />statir�g that the lot is irregular in shape which has caused the house to be constructed closer to the
<br />'' rear lot line than is typical and which makes it difficult to add improvements to the rear of the
<br />'`� ; house; and that three season porches are a typical innprovement in this neighborhood and allowing
<br />'�'� for the porch to be built vvouid not be granting a special privitege; and,

<br />WHEREAS, the exceptional or extraordinary circumstances apply to this property in that
<br />the lot is inegular in shape, and required that the house be built closer to the rear lot line than is
<br />typical for this district; and,
<br />WI�REAS, the literal interpretation of the provisions oithis Titie would deprive the
<br />appiicant of rights commonly enjoyed by other properties in the same district in that three season
<br />porches are a typical improvement in this neighborhood and eisewhere in the R-i single family
<br />residential district; and
<br />WHEREAS, special conditions or circumstances do not resuit from the actions of the
<br />applicant in that the proposed Iocation of the porch is necessitated by the �acation of the existing
<br />house, the existing sliding glass door, and the floor plan for the dirung room where the porch will
<br />atfiach to the house; and,
<br />WHEREAS, grantin� the variance requested will not confer on the applicant any speciaf
<br />privite�e that is denied by this Title to owners or othee lands, structures or buildings in the same
<br />district in thai three season porches are a typical improvement for single family resiclences; and,
