That granting the variance requested wili not confer on the applicant any special privilege
that is denied by this Title io owners or other lards, structw°es or buildings in the sarne
district,
e. That the variance requested is the minimum variance which would alleviate the laardship.
Economic conditions alone shal not be considered a hardship.
£ The variance would not be materially detrimentai to the purpose of this Title or to other
praperty in the same zone.
g. The proposed variance will not iunpair an adequate supply of light and air to adjacent
properiy or substantially increase the congestion of the public streets or increase the danger
of fire or endanger the public safety or substartialiy diminish or impair property values
within the neighborhood. The Board of Adjustment and Appeals may impose such
restrictions and conditions upon the premises benefited by a variance as may be necessary to
compiy with the standards estabiished by this Title or to reduce or minimize the effect of
such variance upan other properties in the neighborhood and to better carry out the intent of
the variance.
Attaehrnents: Planning Apptication
Zoning Map
Diagram showing relationship of buildings
(approximated from aerial photos)
Construction Drawings (reduced)
Diagram showing dimensions between buildings
Hardship Statement
Resoiu#ion 479-96
ackgrouaad:
The appiicant hired Vic & Son Construction to construct a second story addition and a
rear entrance to their home to protect the back door fram weather. It consists of an
enctosed landing and flight of steps. There is an existing garage behind the house which
was not shown on the buiIding plans. The rear entrance has been constructed and is
located within 3 feet 4 inches of the garage. Staffdiscovered the problem with the
distance between the rear entrance and the garage when inspecting the canstruction. The
garage was not shown on the building plans.
Section I lOb.03 Subd. l.c. requires accessory buildings io be at least six feet from any
other buiiding or structure on the same lot. The appIicant is requesting a variance to allow
the rear entrance to be less than the six foot requirement of the Zoning Code.
;
