Silver Lake Commons Minor Subdivision Request <br />Meetang Date: September 17, 1997 <br />Page 2 <br />Pcr�°k,�edicatron Rec�uirerraents� <br />5ectiior� i204.02 of th� Ivlounds �Tiew Municipal Code requires that any subdivider of land shall <br />either dedica�c� land or rnake a payment to the City for park dedication purposes in an amount s�t <br />forth by the Code. For residential developments, this fee is based on gross density, or in other <br />words, dwe�iing units per acre. Far developments having �ross densities in excess of 5 dwelling <br />uniis per acr�, ihe fee is an amouni equal to �en percent of ihe fair market value of ihe land 6eing <br />subdivided. 5ince an appraisal of the vacant lat has not been accomptished, siaff and the applicant <br />proposes to substitute ihe actual purchase pric� for the lots, which is $75,000. TJsing this figure, <br />the appropriate park dedic�tion fee wouId be $7,500. S�af�will require ihai this fee be paid prior <br />to b�ailding permits being ohtained for this development. <br />Easerrrents: <br />5taffhas requested that e�sements be dedicated for dra�nage and utility purposes on the combixced <br />loi a(ong the property lines. ien feet will be required along the front and rear properiy l�nes and <br />five feet for th� side property lines, which are shown on the Certi�ic�.te of Survey. These <br />easements shall be �xec�ated by means of a document to be recorded with Ramsey County prior io <br />th� Mayor's and the City Administrator's signatures on the Certifcaie of S�arveq. In addition, a <br />shared access drivevvay easement vvill need to be executed prior to City Council action on this <br />minor subdivision. Upon approva.l af this request, the sha�°ed access driveway easement shatl be <br />recorded with Itamsey County. This easement will guarantee vehiele access to the apartmeni <br />buildings �via the access from the townhome parcel. <br />�cm�es to Survev: <br />At the Pianning Commissiott's last rrteeting on �eptember 3, 1997, staff reques�ed ihai the <br />Certificate tif Survey be amended to reflect the additian oithree things: (1} the tit1� "Certificaie <br />of Stervey, "(2) a signaiure block bearing the names of the Ivlayor, Duane McCarty, and City <br />Administrator, Charles 'Whiting; in addition to the name(s) of the properiy ownees of the <br />development shall be added to the survey, and (3} a block of text regarding the drainage and <br />utility easement. Tl�is has all beer� accomplished varith the exception oi a place for the owners o� <br />the property to sign on the c�rtificate of survey.
