1006.Ob: <br />DEVELOPMENT CQNTROLS: <br />Subd.1. Purpose: It is the intent and purpose of this Section to provide for orderly development of land to <br />safeguard life, health, safety, property and public welfare by regulating and controlling aII development <br />within the City. This Section shall be in addition to the requirements of any other provisions of the <br />Municipal Code regulating such development. <br />Subd.2. Applicadon of Development Controls: All proposed industrial, commercia� and residential <br />developments and e�ansions of existing facilities, except developments where public utilities and streets <br />have previously been insta]Ied and the erection of no more than two (2) detached single-fa.mily dwellings <br />are planned, must be reviewed by the City Planning and Zoning Commission and approved by the City <br />Council as conformzng to this Section. The term "development", as used hereit� shall mean all <br />. construction, public and private improvement, expansion or alteration offacilities and land within the City. <br />Subd. 3. Development Plan: <br />a. The owner or developer shall submit for review a development plan which sets forth plans for utility <br />service, surface water draina.ge consistent with the Local Water Management Plan dated February 12, <br />19901, subject to subsequent revisions, erosion and sediment controI consistent with the Ramsey County <br />Erosion and Sediment Control Handbook (1989) prepared by the Ramsey County Soil and Water <br />Conservation District and subsequent revisions thereto, streets, parking landscaping, screening and <br />buffering, lighting, setbacks, exterior construction design and materials, trash disposal, constxuction <br />timetable and such other matters as the Council may requue. <br />b. The owner or developer shall submit with the developmerrt plan an abstract of title, registered property <br />report or such supporting affidavits or documents that establish ownership or any other parties ofinterest in <br />the property involved. <br />Svbd. 4. Development Contract: <br />a. A development contract which sets forth all of the terms, conditions, requirements, agreements, <br />guarantees and plans for the orderly development of said land shall be entered into between the developer <br />and the Municipality prior to the final approval of any subdivision, rezoning, specia� use pemvtsz, license or <br />any building permits required for the construction, alteratioq expansion or improvement of said land. <br />b. Before execution of the development contract, the ovvner or developer shall submit certification from <br />Ramsey County Department of Taxation �hat all taxes and special assessments due on the property <br />involved have been paid in full. <br />c. Said development contract sha1l include provisions for supervision of details of construction by the City <br />and grant to the City authority to inspect all work performed pursuant to said contract to assure <br />satisfactory perfo�ce and completion of the work.
