Planning Commission Report <br />November 7, 2001 <br />Page 2 <br />2) If the construction involved increases the overall size of the principal building by <br />less than ten percent (10%). <br />Required Development Contract <br />Section 1006.06 Subd. 4 currently reads as follows: <br />A development contract which sets forth all of the terms, conditions, requirements, agreements, <br />guarantees and plans for the orderly development of said land shall be entered into between the <br />developer and the Municipality prior to the final approval of any subdivision, rezoning, special <br />use permits, Iicense or any building permits required for the construction, alteration, expansion <br />or improvement of said land. <br />The main concern with this section is that it is unciear as to which types of projects require a <br />development contract. Do aIl develapment projects listed in the section require a contract, or only <br />those that have completed ihe development review process? Staff's interpretation is that only those <br />proj ects that qualify for development review should require a development contract. The following <br />text could replace the existing section to rnore clearly define the intent of the Code: <br />A development contract which sets forth all of the terms, conditions, requirements, <br />agreements, guarantees and plans for the orderly development of said land shall be �� <br />entered into between the deveioper and the MunicipaliLy prior to the final approval of � <br />any project that qualifies for a Development Review, as determined by Section 100b.06 <br />Subd. 2 of this Code. <br />Recommendation: <br />Discuss the existing requirements and those presented in this report. Resolution 676-01, a resolution <br />recom�mending approval of the atiached Ordinance, is attached to ihis report.
