AN ORDINANCE FOR THE <br />PURPOSE OF PROMOTING <br />THE PUBLIC HEALTH, <br />SAFETY, ORDER, COM- <br />MERCE, PROPERTY AND <br />GENERAL WELFARE BY <br />PROVIDING FORTHECLAS- <br />SIFICATION, REGULATION <br />AND RESTRICTION OF THE <br />ERECTION OF TRADE AND <br />INDUSTRIES AND OF <br />BUILDINGS USED FOR HU- <br />MAN HABITATION AND <br />FOR SPECIFIED PURPOSES, <br />REGULATING AND DETER- <br />MINING THE MINIMUM <br />SIZE OF YARD AREAS, ES- <br />TABLISHING THE BREAK- <br />DOWN OF DISTRICTS FOR <br />SAID PURPOSES, AND PRO- <br />VIDING PENALTIES FOR <br />- <br />VIOLATION THEREOF, AND <br />PROVIDING FOR AN ADOP- <br />TION OF AN OFFICIAL VIL- <br />LAGE OF MOUNDS. VIEW <br />ZONING MAP. _ <br />The Village of Mounds View.does <br />ordain: <br />SECTION 1 <br />TITLE, PURPOSE AND <br />INTENT <br />This ordinance shall be known, <br />cited and referred to as the <br />"Mounds View Zoning Ordi, <br />nance," except as referred to <br />herein; where it shall be known <br />as "this ordinance." <br />The provisions of this Ordi, <br />hance shall be minimum require- <br />ments, adopted to protect the <br />public health, safety, morals, <br />comfort and general welfare of <br />the people. It shall divide the <br />Village into use districts for re- <br />stricting and regulating therein <br />the locations, erection, construc- <br />tion, reconstruction, alteration <br />and use of buildings, structures <br />and land, and for regulating the <br />population densities throughout <br />the Village. <br />Said restrictions and regula, <br />tions are for the purpose of pro- <br />tecting the character and stabil- <br />ity of the residential, business <br />and manufacturing areas and to <br />promote the orderly development <br />of such areas; to provide ade- <br />quate light, air and convenience <br />of access to property; to provide <br />regulations which will limit con- <br />gestion in the public rights-of- <br />way; to prevent overcrowding of <br />land and undue concentration of <br />structure by regulating the use <br />of land and buildings and the <br />bulk of buildings in relationto <br />the land surrounding them; to <br />provide compatibility between <br />different land uses; to provide <br />for administration of said Ordi- <br />nance; to provide for amend- <br />ments; to prescribe penalties for <br />the violation of said restrictions <br />and regulations. <br />SECTION 2 <br />RULES AND DEFINITIONS <br />2.1 RULES: The language set <br />forth in the text of this Ordi- <br />nance shall be interpreted in <br />accordance with the following <br />rules of construction. <br />2.1-1. The singular number in - <br />eludes the plural and the plural <br />the singular. <br />2.1-2. The present.tense includes <br />the past and future tenses, and <br />the future the present. <br />2.1-3. The word "shall' is'man'- <br />datory, whilethe word "may" <br />is permissive. - <br />2.1-4. - The Masluine, gender <br />includes the feminine and -neu- <br />- ter. '- <br />2.1-5. Whenever a word or term <br />defined hereinafter appears in <br />the text of this Ordinance, its <br />meaning shall be construed as <br />set forth in the definition there- <br />of, other words or terms shall <br />be construed ashaving their <br />common meaning. <br />2.1-6. All measured distances <br />expressed in feet, shall be to the <br />nearest tenth of a foot. <br />2.2. DEFINITIONS: The fol- <br />lowing words and terms,, where - <br />ever they occur in this Ordinance, <br />shall be defined as follows: <br />2.2-1. Airport or Heliport. Any <br />land or structure which is used <br />or intended for use, for the <br />landing and take -off of aircraft, <br />and any appurtenant areas - <br />which are used or intended- for <br />useforport buildings or other <br />port structures or 'rights-of-way. <br />2.2-2. Accessory Use or Struc- <br />ture. A use or a structure Sub- <br />ordinate to the principal use or <br />. structure on the, same lotand <br />customarily incidental thereto.. <br />2.2-3. .Alley. Apublic. right-of- <br />way, with a width not exceed- <br />ing 24 -feet nor less -than sixteen <br />(16) feet which affords- a -sec- <br />_ ondary means of access to abut- <br />ting property. <br />22-5. Automobile. .Repair. -Major. <br />General repair, rebuilding or <br />reconditioning of engines, mo- <br />tor vehicles or trailers, including <br />body work, frame work and <br />painting. <br />2.2-6. Automobile Repair -Minor. <br />Minor repairs, incidental body <br />and fender work, minor paint- <br />ing and upholstering service, <br />replacement of parts and engine <br />service to passenger vehicles <br />and trucks not exceeding three- <br />quarter 00 ton capacity. <br />2.2-7. Auto Reduction Yard. An <br />open lot or yard where two (2) <br />or more unlicensed motor ve- <br />hicles or the remains thereof <br />are kept for the purpose of dis- <br />mantling, sale of parts, sale as <br />scrap, storage or abandonment. <br />2.2-5. Automobile Service Sta- <br />tion (Gas Station). A place <br />where gasoline, kerosene or any <br />other motor fuel or lubricating <br />-oil or grease for operating mo- <br />tor vehicles is offered for sale <br />tothepublic and deliveries are <br />made directly into motor ve- <br />hicles. <br />2.2-9. Basement. A portion of a <br />building located partly under- <br />ground, but having less than <br />half its clear floor -to -ceiling <br />height below the average grade <br />of the adjoining ground. <br />2.2-10. Boardinghouse (Room - <br />House). A building other <br />than a motel or hotel where, <br />for compensation and by pre- <br />arrangement for definite per- <br />. iods, meals or lodging and meals <br />are provided for three (3) or <br />more persons but not to exceed <br />eight (8) persons. <br />2.2-11. Building. Any structure <br />having a roof which may pro - <br />,vide shelter or enclosure of per- <br />sons, animals or chattels and <br />when said structure is divided <br />Eby party walls without open- <br />ings, each portion of such build- <br />ing so separated shall be deem- <br />ed a structure. <br />2.2-12. Building Height. Build- <br />ing height is to be measured <br />from the average established <br />curb level or from the average <br />ground level at the building line, <br />whichever is higher, to the top <br />of the, cornice of a flat roof, to <br />the deck line of a mansard roof <br />and to the mean distance of the <br />highest gable on a pitched or <br />hipped roof. <br />22-13: ' Carport. Space for the <br />-,housing or storage of motor ve- <br />hicles.and enclosed on not more <br />than two (2) sides. <br />2.2-14.- Cellar. That portion of <br />the building having more than <br />half of the clear floor -to -ceiling <br />heights below the average grade <br />of the adjacent ground. <br />2.2-15. Dog Kennel. Any prem- <br />ise where more than two (2) <br />but not more than four (4) <br />dogs, six (6) months of age are <br />owned, boarded, bred or offered <br />
