<br />SECTION 3
<br />GENERAL -PROVISIONS.
<br />34 APPLICATION: Except as
<br />hereinafter provided, no building,
<br />structure or land shall be occu-
<br />pied or. used which is not in con-
<br />formity with this ordinance.
<br />3.2 NON -CON FORM ITy-USES:
<br />3.2-1 :Any -building, structure,or
<br />use lawfully existing at the time
<br />of enactment of .this Ordinance
<br />-.may be, continued- at.. the size
<br />..and ina-mannerof operation as
<br />existing upon theeffectivedate
<br />of this - Ordinance except as
<br />hereinafter specified. .Nothing
<br />in this Ordinance shall prevent
<br />-the placing of - a- building or
<br />structure in safe condition when
<br />said building or structure is de-
<br />clared unsafe by the Building
<br />Inspector. , ..
<br />3.2-2 Whenever- any part of -a
<br />fi>uilding; structure or parcel of
<br />'land occupied by a non,conform-
<br />"ing'use is changed- to or re -
<br />'placed by a use conforming to
<br />the provisions of this Ordinance,
<br />such building, structureor par-
<br />-,eel of
<br />ar--,ee1_of land shall not return to
<br />.the original or any other non-
<br />iemiforming use. _.
<br />3.2-3 Whenever a --non conform-
<br />ing..building or structure shall
<br />havebeen damaged by fire,
<br />-flood,:, explosion,: earthquake,
<br />war,riot orothercalamity, it
<br />may be reconstructed and used
<br />as before if it - becompleted
<br />Within twelve (12) months after
<br />such calamity; unless the dam-
<br />age to the building or structure
<br />was 50% or .more of its fair
<br />market value as determined by
<br />the Village Council, in which
<br />case the reconstruction shall be
<br />for a use in accordance with the
<br />Provisions of this Ordinance.
<br />3.2-4 Whenever a non-conform-
<br />ing'use of a building, structure
<br />or land shallhave been discon-
<br />tinued for a period of six (6)
<br />months it shall not return to
<br />the original or any other use
<br />which is nonconforming within
<br />the district in which it is lo-
<br />cated.
<br />3.2-5 - Any non -conforming use
<br />of land- not involving a building
<br />or structure and 'any non -con-
<br />forming use involving a build-
<br />ing or structure with an assess-
<br />ed -value at the date of enact-
<br />ment of thisOrdinance of Five
<br />Hundred ($500.00) Dollars or
<br />less may be continued for a per-
<br />iod of eighteen (18) months
<br />'after the enactment of this Or-
<br />dinance, whereupon such non-
<br />conforming use shall cease. The
<br />above' regulation shall apply to
<br />sign' boards and bill boards
<br />which," if not brought into con-
<br />formance, shall be removed
<br />tram the site. -
<br />3.2-6 Any building ror structure
<br />Which will under. this Ordinance
<br />-become non -conforming but for
<br />which a permithas been law-
<br />fully granted prior to the effec-
<br />tive date of this Ordinance or
<br />of amendments thereto, may be
<br />completed- in accordance with
<br />the .approved .plans; provided
<br />construction is started within
<br />,six (6) months of the effective
<br />-date and continueslto comple-
<br />tion within two (2) :years, Such,
<br />shallthereafter be deemed a
<br />legally- existing non -conforming
<br />°building or structure.. -
<br />3.2-7 A non -conforming use of a
<br />structure, building or parcel of
<br />land may, be;:changed to a more
<br />restricted nonconforming use.
<br />However, once- a structure,
<br />building or parcel of land has
<br />- been placed in a more restrictive
<br />non -conforming use it shall not
<br />return to a less restrictive non-
<br />conforming use. - -
<br />3.2-8. Normal maintenance of
<br />building or other -structures
<br />containing or related to a non-
<br />conforming use is permitted, in-
<br />cluding
<br />neluding necessary non-structur-
<br />al repairs and incidental altera-
<br />tions - which do not extend or
<br />intensify the. non -conforming
<br />use.
<br />3.2-9 Alterations may be made
<br />-to a building containing non-
<br />conforming residential units
<br />when .it -will imporve the liva-
<br />bility provided it - does not in-
<br />crease thenumberof dwelling
<br />units or bulk of the building.
<br />3.3 LOT PROVISIONS:'
<br />3.3-1 A lot or parcel of land for
<br />which a deed has been recorded
<br />in the office 'of - the Ramsey
<br />,County Register ofDeedsupon,
<br />or prior to the effective date
<br />of this Ordinance shall be�tleem-
<br />ed a buildable lot provided it has
<br />frontage on a public right -of -
<br />may and said -space``require-
<br />ments for the district in which
<br />'it is located can be maintained
<br />-or adjusted to conform as fol-
<br />lows:
<br />3.3=2 A -platted lot or parcel of
<br />land of record upon the effec-
<br />tive date of this Ordinance
<br />which does not meet the re-
<br />quirements of this Ordinance as
<br />to area, width -or -other open
<br />space, may, if! it is properly
<br />zoned, be 'utilized for - single
<br />family detached dwelling pur-
<br />poses provided the measure-
<br />ments of such area, width or
<br />open. space are within 70% of
<br />the _requirements 'under the
<br />terms of - this Ordinance, but
<br />said lot- or parcel shall not be
<br />more intensively - developed.
<br />Such existing lots that fall with-
<br />in 70% of the requirements and
<br />have 'lot widths: less than re-
<br />quired by this Ordinance, shall
<br />be permitted to have side yard
<br />.set backs in the same percen-
<br />tage proportion as the lot width
<br />'reaches the.,requirement of this -
<br />Ordinance. In no caseshall a
<br />-side yard set back be less than
<br />five feet.
<br />3)3-3 -Where two or more con-
<br />tigous vacant lots are held in
<br />common ownership within a
<br />'subdivision which was duly re-
<br />corded 'prior to the effective
<br />date of this Ordinance, which
<br />lots are individually not of the
<br />required minimum area or width
<br />-for the district in which they
<br />are situated, building permits
<br />will be issuedprovided that
<br />such lots shall 'be- combined ,. in
<br />such a way as to providethe
<br />minimum lot frontage and area
<br />required for each structure. The
<br />purpose of this provision is to
<br />permit utilization of isolated re-
<br />corded lots which lack adequate
