<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 2486 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT <br />AND TWO CONDITIONAL USE PERMITS FOR EVEREST <br />DEVELOPMENT'S TACO BELL AND KENTUCKY FRIED CHICKEN <br />RESTAURANTS, PLANNING CASE NOS. 264-89 AND 265-89 <br /> <br />WHEREAS, Everest Development has requested approval of a <br />Planned Unit Development and two conditional use permits to allow <br />Taco Bell and Kentucky Fried Chicken Restaurants at the property <br />located at the southeast corner of Highway 10 and Quincy Street, <br />legally known as Lot 1, Block 5, Mounds View Business Park~ and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />applicant's request for a planned unit development and <br />conditional use permits and determines that it is in conformance <br />with Chapters 40 and 42 of the City Code~ and <br /> <br />WHEREAS, the Planning Commission has determined a finding <br />of fact that the proposed planned unit development/conditional <br />use permit meets the following criteria: <br /> <br />a. The use will not create an excessive burden on <br />existing parks, schools, streets and other public <br />facilities and utilities which serve or are proposed <br />to serve the area. <br /> <br />b. The use will be sufficiently compatible or separated <br />by distance or screening from adjacent residentially <br />zoned or used land so that existing homes will not be <br />depreciated in value and there will be no deterrance <br />to development of vacant land. <br /> <br />c. The structure and site shall have an appearance that <br />will not have an adverse effect upon adjacent <br />residential properties. <br /> <br />d. The use, in the opinion of the City Council, is <br />reasonably related to the overall needs of the City <br />and to the existing land use. <br /> <br />e. The use is consistant with the purposes of the Zoning <br />Code and the purposes of the zoning district in which <br />the applicant intends to locate the proposed use. <br /> <br />f. The use is not in conflict with the Comprehensive Plan <br />of the City. <br /> <br />g. The use will not cause traffic hazards or congestion. <br />
