<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 5184 <br />Silverview Estate Development Review <br />December 8, 1997 <br />Page 2 <br /> <br />WHEREAS. Ramsey County has approved the site plans subject to dedication of <br />additional right of way for Silver Lake Road; and, <br />WHEREAS, Rick Wriskey, the Mounds View City Forester, has reviewed the landscape <br />plans as presented and finds them acceptable; and, <br /> <br />WHEREAS, Mark Bishop, the Mounds View Fire Marshal, has reviewed the plans and <br />finds them acceptable with stipulations; and, <br /> <br />WHEREAS, the Mounds View Planning Commission on November 19, 1997, approved <br />Resolution No. 526-97 which recommended approval of the preliminary plat, and Resolution No. <br />515-97 which recommended approval of the development review for the Silverview Estates PUD. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves <br />the Development Review request by Silverview Estates Development Company contingent upon <br />the requirements as set forth in Exhibit 1 of this resolution hereof and the following: <br /> <br />1. The car wash developer/operator shall recycle a minimum of sixty percent (60%) of the <br />water used in the car wash process. <br /> <br />2. <br /> <br />The recreational vehicle service center drain accessing the sanitary sewer system shall be <br />kept locked or secured to prevent unauthorized dumping and to ensure controlled access. <br /> <br />3. The applicant shall work with the St. Paul Water Utility to ensure that the drainage <br />culverts are operational. <br /> <br />4. The following shall be completed before the final stage of the PUD can be approved: <br /> <br />a. The City Engineer shall (1) review and approve the proposed gazebo at the rear of <br />the 2-story otlice building to ensure that the manner in which it is designed and <br />constructed will not impede surface water flow from the current site of Winiecki <br />Insurance ffi1d (2) review and approve the new location for the NURP pond outlet <br />on Lot 3 and the revised NURP pond overflow position on Lot 4. <br /> <br />b. A development contract which sets forth all of the terms, conditions, <br />requirements, agreements. guarantees and plans for the orderly development of <br />the land shall be executed as required by Section 1006.06, Subd. 4 ofthe City <br />Code. <br /> <br />c. <br /> <br />The Development Plan shall be modified to reflect an increased setback for the <br />gazebo from the rear lot line of the Winiecki property to conform with City <br />setback requirements for accessory structures. <br />
