Review and Construction Process <br /> <br />(1) The building and parking lot setback for Lot 4 may be reduced to 27 feet as <br />part of an approved development plan, as long as Building Code requirements <br />are met. <br /> <br />(2) Setbacks from interior lot lines(not abutting streets) may be reduced to 0 <br />feet as part of an approved development plan, as long as Building Code <br />requirements are met. <br /> <br />(3) Except as shown on tl/e approved development plan and with approval of <br />a wetland alteration pennit by City Council. <br /> <br /> <br />(4) TI/e minimum setback from the private drive may be reduced to 0 feet <br />where it functions as a drive aisle through the parking lots for the uses east of <br />the gas station/convenience market/car wash The drive shall be delineated <br />by landscaped islands where it abuts the end of parking bays. <br /> <br />(5) Notwithstanding the definition in Chapter 1102 of the Zoning Code, <br />building height sf/all be defined as the vel tical distance between the average <br />foundation elevation and the higt/est point of the structure above finished <br />grade. The average foundation elevation sl/all be detennined by using the <br />highest and lowest elevations of a building's foundation, measured at the point <br />where the foundation intersects finisl/ed grade, exclUding any benning against <br />exterior walls. <br /> <br />(6) May be reduced to 5 feet if a 10 foot easement is obtained from MnDOT for <br />sidewalk and landscaping improvements in the Highway 10 right-of-way (see <br />Section 19). <br /> <br />(7) Parking stall dimensions shall be either 10' x 18' or 9' x 20'. In no case <br />shall the actual stall area fall below 180 square feet. <br /> <br />SILVERVIEW ESTATES PLANN~D UNIT DEVELOPMENT <br />2704-2740 HlGBWA Y 10 & 7801 SILVER LAKE RD <br />PAGE30Fll <br /> <br />· General Concept Plan <br />The general concept plan for this PUD (originally known as the D.W. <br />Jones PUD) was approved May 27, 1997, by the Mounds View City <br />Council in Resolution 5127. The approved general concept plan <br />included stipulations as set forth in Exhibit 1 of Resolution 5127, and <br />the plans as prepared by E.G. Rud & Sons. Inc, dated 5/22/97 and <br />placed on file in the Mounds View Community Development <br />Department under Planning Case No. 477-97. <br /> <br />· Development Stage Plan <br />For this PUD, the development stage plan shall be used to finalize <br />allowed densities, which may be lower than the maximum densities <br />listed in Section 3, based on the factors stated in Section 3. The <br />development stage plan shall also be used to address the design <br />issues stated in Section 16. <br /> <br />The development stage plan shall include these stipulations (Exhibit 1 <br />of Resolution No. 5184) and the plans prepared by Charles J. Radloff; <br />et. aI., bearing the date-stamp 12/1/97 and placed on file in the <br />Mounds View Community Development Department under Planning <br />Case No. 502-97. <br /> <br />. Final Plan <br />Prior to the issuance of any building or grading permits, the property <br />owner or their agent shall obtain approval for a final plan and <br />construction drawings from the City in accordance with Sections <br />1120.04 and 1000 of the Mounds View Municipal Code. Clearance of <br />vegetation is permitted after building and grading permits are issued in <br />accordance with the approved plans. The final plan shall be recorded <br />by the property owner with the County Recorder's Office, and proof of <br />recordation shall be provided to the Community Development Depart- <br />ment within 30 days of the date of approval.
