<br />EXHIBIT A <br /> <br />. <br /> <br />ADMINISTRATIVE POLICY <br /> <br />CITY OF MOUNDS VIEW <br />SMOKING AND TOBACCO USE POLICY <br /> <br />PURPOSE <br /> <br />In accordance with the Minnesota Clean Indoor Air Act and in recognition of <br />the need to provide a smoke-free environment for City employees and <br />visitors, a smoking policy and tobacco use policy is established, effective <br />January 1, 1992. <br /> <br />POLICY <br /> <br />Section 1. Smoking of any kind; including pipes, cigars and cigarettes or <br />the use of chewing tobacco, will not 'bepe~itted in any City-owned <br />building except as otherwise outlined in Section 7 herein. <br /> <br />Section 2. Smoking of any kind; including pipes, cigars and cigarettes or <br />the use of chewing tobacco, will no longer be permitted in any City-owned <br />vehicle. <br /> <br />Section 3. Smoking by City employees will not be permitted outside of the <br />~nt entrance of City Hall. <br /> <br />Section 4. The Police Department is granted special discretion in regard <br />to this policy when questioning a witness or suspect of a crime. This <br />smoking and tobacco use privilege may only be granted to a member of the <br />public and not to a City employee, including Police Officers, unless they <br />are being questioned. <br /> <br />Section 5. Employees who violate the smoking and tobacco use policy will <br />be subject to disciplinary action as follows. <br /> <br />. First Violation verbal warning <br />. Second Violation written warning <br />. Third Violation suspension without pay <br />. Subsequent Continual Violation could result in involuntary <br />termination of employment <br /> <br />Section 6. An employee who has a grievance or a concern shall follow the <br />Grievance Policy outlined in Chapter 6, Section 6.10 of the Municipal Code <br />or the grievance procedure outlined in their respective collective <br />bargaining agreements. <br /> <br />Section 7. Smoking is permitted for City employees ONLY in the following <br />designated areas: <br /> <br />. <br /> <br />. <br /> <br />Public Works Garage excluding offices, break and storage <br />areas and bathrooms <br /> <br />. Police Garage <br />
