<br />. <br /> <br />. <br /> <br />6. <br /> <br />.7. <br /> <br />Resolution 5599 <br />August 27,2001 <br />Page 2 <br /> <br />WHEREAS, the Mounds View City Council finds that the request is consistent with <br />the Mounds View Comprehensive Plan in that the Comprehensive Plan encourages <br />commercial development along County Highway 10 to provide a broad tax base and <br />expanded employment base; and, <br /> <br />WHEREAS, the Mounds View City Council finds that the proposed animal hospital <br />would not be out of place given the character and geography of the surrounding area <br />involved in that there is other commercial development to the south of the property and to <br />the west of County Highway 10; and, <br /> <br />WHEREAS, the Mounds View City Council finds that the proposed animal hospital <br />would not depreciate the neighborhood; and, <br /> <br />WHEREAS, the Mounds View City Council finds that the applicant has sufficiently <br />demonstrated that they have outgrown their current facility and a need exists for a larger <br />facility that can be accommodated on the subject property; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the conditional use permit with the following stipulations: <br /> <br />1. The applicant shall arrange to record the City Council resolution approving the <br />conditional use permit with Ramsey County and provide proof of such recordation <br />to the City within sixty days of Council approval or this permit shall be considered <br />null and void. <br /> <br />2. <br /> <br />Noise and odor are effectively confined to the premises in accordance with Chapter <br />607 of this Municipal Code, Nuisances. <br /> <br />3. <br /> <br />A mechanical ventilation or exhaust system shall be installed to control, capture and <br />remove emissions or odors generated by such use. Such systems shall be separate <br />from other ventilation systems in the building. Such system shall be designed to <br />prevent the migration of emissions or odors to other parts of the building. Installation <br />must comply with Minnesota Building Code Mechanical Systems, chapter 1345. (Ord. <br />441, 5-23-88) <br /> <br />4. <br /> <br />All animal boarding activities shall be conducted indoors, except for necessary <br />outdoor exercise. At no time shall any animal be left unsupervised while outdoors. <br /> <br />Outdoor exercise shall be conducted so as not to unreasonably annoy, injure or <br />endanger the health, safety, comfort, or welfare of the public. <br /> <br />5. <br /> <br />The facility shall comply with the Nuisance Codes established for the City of <br />Mounds View. <br />The facility shall comply with the Minnesota Pet and Companion Animal Welfare Act <br />(Minn Statutes 346.35 - 346.44) <br />
