FLwNAEA1 <br />�109�1-1V>11 <br />Our office has served as attorneys fcr a number of years <br />for Pinecrest Yroperties, a general partnership consisting of <br />Russell H. Undetdahl and William H. Beim. The partnership owns <br />a tract of land in City of Mounds View which was platted in June, <br />1969 as Pinecrest Addition, part of the property being zoned for <br />multiple housing and the remainder for commercial or light industrial <br />usea. <br />We are advised that in 1976, a comprehensive plan was devel- <br />oped for the city with respect to future development of real estate <br />located therein. Such plan required Pinecrest Addition to be <br />replatted eo that the whole may be developed fox comnercial or light <br />industrial usea. The proposed replat as Northcrest Addition requires <br />aubstantial change in lots and lot sizes, atreets, location of <br />utilities, and vacation of Raymond Avenue. In addition, the city <br />has implemented Section 462 358 Subd. 2, Minnesota Statutes, which <br />permita the muna#d�pali�.y t.^� '=-i�. as parG. a� �M� �g,�,f[g��1 developmenC and. <br />platting procedure the dedication of "a reaso"hab7.e'°pBi�Eion'`of ea`eii <br />proposed subdiviaion" for park and eimilar purposes-or, in lieu <br />thereof•, payment by the subdivider of an equivalent amount in cash. <br />Pinecrest Addition has been recently appraiaed and it has been aug- <br />gested that lOX of such appraised value, or $53,000 in cash, be paid <br />to the city pureuant to the above statute and ordinancea of the city. <br />
