Crerters: <br />Ne have revieo�ed your proposat dated January 11> 7979, and found it to be <br />totally imacceptable. It appears that your firm is unwilling to negotiate <br />and discuss this issue in a professional and realistia--ye.ir,.• <br />The factr of the situation are very clear: <br />1. The City presently�owns 16.5 acres of prime buildable property at <br />the intersection of County Road N-2 and Sitver Lake Road. <br />2. The developer is required by City Ordinance (Chapter 42, Subdivision <br />1) to dedicate }��..cash_or_Sand.=��equivatent at the tirtx of subdivision. <br />It should also be noted that this ordinante does not ailow the City to <br />consider "storm water holdin9 areas or ponds, whetfier required by the <br />Municipality or any otAer re9ulatory boQy" as a portion of the required <br />dedication. <br />3. The City has obtained a State and Federal L.A.W.C.O.�i. grant for Lhe , <br />acquisition of land for Silver View Park. -- <br />4. The City requires by ordlnance (Chapter 4C;04, Subdivision E) that the � <br />developer must sudnit a copy of the final drainage plans for the proposed .. <br />developnznt to 62 approred by the City Engineer. In addition "all <br />drainage plans shall conform to the wmprehensive storm drainage plan of <br />ifie Municfpality". - � <br />
