3.6 Upon collection by the owner or the owner's contracted independent hauler, that <br /> person shall deliver the designated recyclables to a recyclable material processing <br /> center, an end market for sale or reuse, or to an intermediate collection center for later <br /> delivery to a processing center or end market. No recyclable materials placed by <br /> residents in the multiple-unit recyclables collection containers will be collected or <br /> disposed of as garbage. It is unlawful for any person to transport for disposal or to <br /> dispose of separated designated recyclables in a mixed municipal solid waste disposal <br /> facility. The contractor or hauler shall transport all designated recyclables in a <br /> covered vehicle so the recyclables do not drop or blow onto any public street or <br /> private or public property during transport. <br /> 3.7 It is unlawful for any person, other than the owner or the owner's independent hauler, <br /> to collect, remove, or dispose of designated recyclables after the materials have been <br /> placed or deposited for collection in the recycling containers. The owner, owner's <br /> employees, owner's independent hauler's employees, or City's recycling contractor's <br /> employees may not collect or"scavenge"through recycling in any manner. <br /> 4 Multiple-Unit Recycling Program <br /> 4.1 Each owner of a building containing four (4) or more dwelling units shall provide for <br /> recycling services for all units.'; <br /> 4.2 The owner of a multiple-unit dwelling shall make recycling services available and <br /> convenient to the occupants of all dwelling units on the premise. The recyclables <br /> collection services shall be available on the premises. The collection schedule and <br /> recycling containers' capacity shall provide for regular removal of the recyclables <br /> such that there is adequate storage capacity available in the recyclables containers to <br /> prevent overflowing containers. <br /> 4.3 Recyclable materials for multiple unit dwellings shall include the same list as the <br /> City's residential recycling program (see Sec. 3.2 above) unless the City approves a <br /> variance in writing. <br /> 4.4 All recyclable materials placed by residents in the multiple-unit recyclables collection <br /> containers must be collected at least weekly and processed and marketed for recycling <br /> by a properly licensed recycling company, and all recyclables must be appropriately <br /> recycled as required by Minnesota laws and regulations. <br /> 4.5 Adequate containers shall be in the same enclosure as the garbage containers and <br /> shall be provided and maintained by the owner or by the recyclables hauler, <br /> whichever provides the recycling collection service. Containers shall be: <br /> A. Sufficient in number and size to meet the demands for recycling services created <br /> by the occupants; <br /> B.
