A ten (10) foot easement shall be shown along the right of way and five <br />(5) foot perimeter easements shall be shown for each parcel prior to City <br />signatures being placed upon the "Velmeir CVS Addition" final plat. <br /> <br />7. An easement shall be placed overthe pond and rain garden area prior to <br />City signatures being placed upon the "Velmeir CVS Addition" final plat. <br /> <br />8. Before any construction is to occur, Velmeir will need to submit copies of <br />all required County permits, including permits to work within County right <br />of way. <br /> <br />9. Velmeir shall enter into various agreements with the City and/or the EDA <br />including (but not limited to) the Development Agreement, which sets <br />forth all of the terms, conditions, requirements, agreements, guarantees <br />and plans for the orderly development of the property. <br /> <br />10.A ten (10) foot wide bituminous trail shall be constructed per the City <br />specifications and shall be located according to the site plan date <br />stamped May 20, 2004. <br /> <br />11. City approval is contingent upon the Ramsey County Surveyor's approval. <br /> <br />12. Velmeir shall satisfy all City of Mounds View City Code requirements <br />including, but not limited to, submission of current title work for the <br />Property, the inclusion of appropriate easements for the plat, etc. <br /> <br />13. Velmeir shall prepare a final plat that satisfies all required formalities <br />pursuant to the Mounds View City Code and state statutes. <br /> <br />14. Velmeir shall successfully complete any and all requirements after final <br />review of the final plat by the City Attorney and City Engineer and City <br />Staff. <br /> <br />15. The approval contemplated herein is subject to the condition that Velmeir <br />must pay for all costs incurred by the City concerning this subdivision, <br />including preparation and review of the preliminary and final plat by <br />technical assistants and the costs incurred by the City Attorney, city <br />consultants, as well as other costs of a similar nature. <br /> <br />NOW, THEREFORE, BE IT FINALLY RESOLVED that approval of this final plat <br />is subject to approval by and recordation with Ramsey County, which shall occur within <br />one hundred twenty (120) days of Council approval. Velmeir shall furnish the City with <br />a reproducible copy of the final plat showing evidence of the recording; otherwise, the <br />approval of the final plat shall be void. <br />
