<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5634 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />A RESOLUTION APPROVING A WETLAND ALTERATION PERMIT FOR AN <br />EXPANDED BILLBOARD AT 2373 HIGHWAY 10, REQUESTED BY CLEAR <br />CHANNEL OUTDOOR; PLANNING CASE NO. WA01.Q01. <br /> <br />WHEREAS, Chris McCarver, representing the applicant Clear Channel Outdoor, <br />has requested a wetland alteration permit to allow for the expansion of the existing <br />billboard on Community Center open space land, 2373 County Highway 10, as shown on <br />the attached Exhibit A; and, <br /> <br />WHEREAS, the existing billboard is located within a delineated wetland as shown <br />on Exhibit B; and, <br /> <br />WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland <br />Alteration Permit is required when any activities encroach into a designated wetland; and, <br /> <br />WHEREAS, the City Council has found that wetlands within the City, as part of <br />the ecosystem, are critical to the present and future health, safety and general welfare <br />of the land, animals and people within the City, as well as within the Rice Creek <br />Watershed District; and, <br /> <br />WHEREAS, the City Council has in mind its statutory obligation to comply with <br />Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek <br />Watershed District, Regulations of the Department of Natural Resources, including <br />provisions for protected waters, Public Law 92.500 (Federal Water Pollution Control Act), <br />open space policies of the Metropolitan Council and its guidelines encouraging protection <br />and enhancement of marshes, wetlands in the flood plain area and the public interest in <br />preventing irreparable destruction or deterioration of valuable natural resources; and, <br /> <br />WHEREAS, the City Council has reviewed the following documents regarding <br />this proposal: <br /> <br />a. Planning Application <br />b. Zoning Map <br />c. Site Plan with Landscape Features <br />d. Billboard Elevation <br />e. Extract of Planning Commission Minutes, 9/19/2001 <br />f. Planning Commission Resolution 673-01 <br />g. Easement Purchase Agreement <br />h. Staff Report <br />
