<br />Resolution 5634 <br />Page 2 <br /> <br />. <br /> <br />WHEREAS, the proposed development satisfies the requirements of the Zoning <br />Code and building code; and, <br /> <br />WHEREAS, the proposal satisfies all of the wetland requirements of Chapter <br />1010; and, <br /> <br />WHEREAS, on October 22, 2001, the Mounds View City Council approved <br />Resolution 5627, a resolution approving a development review to expand the existing <br />billboard, with stipulations. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the Wetland Alteration Permit requested by Chris McCarver of Clear Channel <br />Outdoor to expand the billboard located at 2373 County Highway 10 and to make <br />associated landscaping improvements, contingent upon the following: <br /> <br /> a. <br /> b. <br />. c. <br /> d. <br /> e. <br /> f. <br /> g. <br /> h. <br /> <br />. <br /> <br />All fees, legal and otherwise, associated with the easement sale and easement <br />document preparation shall be the sole responsibility of the applicant. <br /> <br />Provide a tree inventory for the area surrounding the billboard, indicating which <br />trees have been targeted for removal. A comolete removal of trees to provide <br />maximum billboard exposure shall not be allowed. <br /> <br />Execute the purchase agreement for the additional easement area, <br /> <br />The utilities to the billboard shall be relocated underground. <br /> <br />Only clean fill, if any is needed, shall be brought onto the site. <br /> <br />No waste, construction or otherwise, shall be allowed to enter into the wetland or <br />any adjoining areas. <br /> <br />The construction of the billboard base shall not impede or otherwise restrict the <br />natural flow of surface water and stormwater runoff. <br /> <br />The applicant, its contractors or representatives, shall be responsible for <br />correcting any damage done to the City's trailway during the construction of the <br />billboard. <br /> <br />i. Any reduction to the available flood storage capacity (area below the 902 <br />elevation) shall be restored or replaced immediately adjacent to the billboard so <br />that there is no net loss of available flood storage capacity to the site. <br /> <br />j. No grading is to occur outside of the 55-foot square easement are without the <br />express written authorization and consent of the City. <br />
