<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5853 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A WETLAND BUFFER PERMIT TO CONSTRUCT A <br />SINGLE FAMILY HOME AT 2824 WOODCREST DRIVE, REQUESTED BY <br />PROPERTY OWNERS LORI FRASE AND KIMBERLY OLSON <br /> <br />WHEREAS, Lori Frase and Kimberly Olson have requested approval ofa Wetland <br />Buffer Penllit for property they own at 2824 Woodcrest Drive, property legally known as: <br /> <br />Lot 106, Kllollwood Park, Ramsey COUllty, Millllesota <br /> <br />WHEREAS, the 40,300 square foot lot is zoned R-1, Single Family Residential; and, <br /> <br />WHEREAS, part of said property is located within one hundred feet of an identified <br />wetland as shown on the attached Wetland Buffer Map labeled "Exhibit A"; and, <br /> <br />WHEREAS, the City Council has found that wetlands within the City, as part of the <br />ecosystem, are critical to the present and future health, safety and general welfare ofthe land, <br />animals and people within the City, as well as within the Rice Creek Watershed District; and, <br /> <br />WHEREAS, the City Council has in mind its statutory obligation to comply with <br />Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek Watershed <br />District, Regulations of the Department of Natural Resources, including provisions for protected <br />waters, Public Law 92.500 (Federal Water Pollution Control Act), open space policies of the <br />Metropolitan Council and its guidelines encouraging protection and enhancement of marshes, <br />wetlands in the flood plain area and the public interest in preventing irreparable destruction or <br />deterioration of valuable natural resources; and, <br /> <br />WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Buffer Permit is <br />required when any construction activities are planned within one-hundred feet of a wetland; and, <br /> <br />WHEREAS, the applicants propose to construct a 2,410 square foot house and a <br />connected 552 square foot two car garage on the site; and, <br /> <br />WHEREAS, the proposed improvements, which total 2,962 square feet, fall completely <br />within the wetland buffer; and, <br /> <br />WHEREAS, no development activities or disturbances of any kind will occur within the <br />wetland itself; and, <br /> <br />WHEREAS, to approve a Wetland Bu1Ter Permit, the City Council shall find that the <br />standards and requirements articulated in section 1010.08, Subdivision 4 of the City Code are <br />satisfied. <br />
