<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution No. 5345 <br />September 13, 1999 <br />Page 2 <br /> <br />WHEREAS, such a facility is a permitted conditional use within the R-4, High Density <br />residential zoning district; and, <br /> <br />WHEREAS, the Mounds View City Council adopted Ordinance 631 on September 13, <br />1999, an ordinance which rezoned the subject property from B-2, Limited Business Commercial, <br />to R-4, High Density Residential; and, <br /> <br />WHEREAS, The Mounds View City Council has considered the specific criteria for assisted <br />living facilities as they appear in Section 1109.04, Subdivision 2 and find that they are met; and, <br /> <br />WHEREAS, the Mounds View City Council has considered the following provisions from <br />Section 1125.01 (l)e of the Zoning Code regarding possible adverse effects of the proposed use: <br /> <br />(1) Relationship to Municipal Comprchcnsive Plan. <br />(2) The gcographical area involved. <br />(3) Whethcr such use will tend to or actually depreciate thc area in which it is proposed. <br />(4) The charactcr ofthc surrounding area. <br />(5) The dcmonstrated necd for such use, <br /> <br />and makes the following findings concerning same: <br /> <br />The Comprehensive Plan designates this site as Mixed Use PUD, which would be consistent <br />with the proposed R-4 zoning of this site. Such a facility would help meet the housing needs <br />ofa particular segment of the community. The property is located between commercial sites <br />to the north and a high density residential development and park to the south. The proposed <br />use would act as a buffer between the existing land uses. The proposed style and architectural <br />design of the proposed facility would blend into and add character to this area. <br /> <br />WHEREAS, The Mounds View City Council makes the following findings that the general <br />criteria for CUP approval in Subdivision 1125.01 (2) have been met: <br /> <br />(1) The use will not crcatc an cxcessive burdcn on existing parks, schools, strccts and other public <br />facilities and utili tics which serve or are proposcd to serve the arca. <br /> <br />It is not expected that this use will have any impact OJl parks, schools, streets and other <br />public facilities and utilities lvhich serve or are proposed to serve the area. <br /> <br />(2) The use will be sufficicntly compatible or separated by distance or scrccning from adjacent <br />residentially zoned or used land so that cxisting homes will not bc depreciated in value and thcre will be <br />no deterrence to dcvelopmcnt of vacant land. <br /> <br />This development, while not ahutting any residential property, would he sufficiently <br />compatihle with the existing land uses and would not cause any foreseeable depreciation in <br />neighboring property values. <br />
