. WHEREAS, in the course of reviewing the documents associated with this property, it <br />was determined that Midwest Motor Express was operating without a conditional use permit, <br />a requirement for motor freight terminals located in an industrial zoned district; and, <br />WHEREAS, the Mounds View Planning Commission held a public hearing on June 7, <br />2006 and approved Resolutions 837-06 and 838-06 which recommended approval of the <br />conditional use permit and development review subject to certain stipulations contained <br />therein; and, <br />NOW, THEREFORE, BE IT RESOLVED, as required by Section 1125.01 of the <br />Mounds View Zoning Code, the Mounds View City Council makes the following findings of <br />fact related to the development review and conditional use permit request: <br />1. The Midwest Motor Express property is zoned I-1, industrial, within which motor <br />freight terminals are conditionally allowed. <br />2. The request is consistent with the Mounds View Comprehensive Plan in that the <br />Comprehensive Plan encourages business to remain and grow in Mounds <br />View. <br />3. The applicant has sufficiently demonstrated that a need exists for the proposed <br />expansion. <br />• 4. Permitting the expansion would not depreciate the neighborhood nor will it <br />cause additional traffic or affect neighboring properties. <br />5. The setback and zoning requirements as indicated in Sections 1104.02 and <br />1106.04 of the Mounds View Zoning Code are satisfied with this expansion.. <br />6. The parking requirements are adequately satisfied and no additional parking will <br />be required with the expansion. <br />NOW, THEREFORE, BE IT FINALLY RESOLVED, the Mounds View City Council, <br />has reviewed the request fora 10,500 square foot addition of dock and warehouse space to <br />the existing Midwest Motor Express building, and based upon the above-stated findings of <br />fact, does hereby approve the development review and conditional use permit requests for <br />Midwest Motor Express, located at 2169 Mustang Drive, subject to the following conditions: <br />1. All disturbed areas shall be restored with sod or asphalt no later than 60 days <br />beyond issuance of the Certificate of Occupancy, weather permitting. <br />2. The. applicant shall provide proof of obtaining a permit from Rice Creek <br />Watershed District if a permit is so required. <br />• 3. The development plans must be approved by the Public Works Director in <br />regards to stormwatei- drainage, prior to a building permit being issued. <br />
