He further reviewed the options available to the City Council. <br /> <br />Finance Director Beer questioned if Mr. Jaru’s application could be corrected and resubmitted to <br />the City of Mounds View. Mayor Flaherty believed this to be an option for the applicant. He <br />understood that Mr. Jaru had limited English skills and encouraged him to have an attorney assist <br />him with all future Mounds View Tobacco applications. <br /> <br />Mayor Flaherty was in favor of the Council moving forward with the tobacco license transfer <br />noting it would only be in effect for the next three months. The Council could then reevaluate <br />the situation at the end of June when the applicant would then have to reapply. <br /> <br />MOTION/SECOND: Flaherty/Mueller. To Waive the Reading and Adopt Resolution 8225, <br />Approving a Transfer of Ownership for a Cigarette/Tobacco Business License Located at Sam’s <br />Market, 2408 County Road I. <br /> <br />Council Member Mueller asked if a criminal background check would be completed on the <br />applicant. Assistant City Administrator Crane stated this was not a requirement for tobacco <br />licenses. She reported she was only required to complete a check with the State to see if the <br />applicant had any tobacco violations. <br /> <br />Council Member Mueller inquired if the City could be held liable if a tobacco license holder <br />failed to report and pay appropriate taxes for tobacco sales. City Attorney Riggs stated the City <br />would not be liable in this situation. <br /> <br />Council Member Gunn questioned the City’s procedure to renew the tobacco license in June. <br />Assistant City Administrator Crane explained a letter would be sent to the applicant by the City <br />in April explaining an application would have to be filled out for the renewal. City Attorney <br />Riggs commented that it was a privilege to hold a tobacco license in the City of Mounds View <br />and not a right. <br /> <br />Council Member Mueller asked if the City how had a copy of Mr. Jaru’s correct address in <br />Fridley. Assistant City Administrator Crane reported she had a copy of Mr. Jaru’s driver’s <br />license on record. <br /> <br />Council Member Gunn inquired if the tobacco license application should be resubmitted with the <br />correct information. City Attorney Riggs stated the Council could direct the applicant to <br />resubmit his application with correct addresses. <br /> <br />Mayor Flaherty questioned if Mr. Jaru had a place of business on Century Avenue in White Bear <br />Lake. Mr. Jaru commented he did not. Assistant City Administrator Crane indicated she had <br />contacted the Secretary of State’s office regarding this matter and Mr. Jaru has not updated his <br />business address information. She reported it was the business owner’s responsibility to update <br />this information. <br /> <br />Council Member Hull asked why the State had Century Avenue as his place of business address.
