Mounds View City Council March 24, 2014 <br />Regular Meeting Page 3 <br /> <br /> Ayes – 5 Nays – 0 Motion carried. <br /> <br />B. Resolution 8225, Approving a Transfer of Ownership for a <br />Cigarette/Tobacco Business License Located at Sam’s Market, 2408 County <br />Road I. <br /> <br />Assistant City Administrator Crane stated that the present owner of Sam’s Market was requesting <br />a transfer of ownership for its tobacco license. She reported all necessary permits and fees were <br />submitted to the City. However, after reviewing the permit, staff has found several <br />inconsistencies with the information submitted by the applicant. The Council may approve, table <br />or deny the request for the tobacco license transfer. <br /> <br />Mayor Flaherty requested further information on the inconsistencies on the application. City <br />Attorney Riggs explained the application had substantive inconsistencies in addition to the <br />corporate entity not having an official address. For this reason, staff was asked to look into the <br />matter further. <br /> <br />Mayor Flaherty asked why the address for the business was filled out incorrectly on the <br />application. Khudier Jaru explained the application was filled out prior to owning Sam’s Market. <br />Therefore an address in Maplewood was used. <br /> <br />Mayor Flaherty questioned how long Mr. Jaru’s business had been in operation. Mr. Jaru <br />reported his business had just opened. He then discussed a Fish and Chicken Restaurant in St. <br />Paul, which he operated for one year that was now closed. <br /> <br />Mayor Flaherty inquired when Mr. Jaru purchased Sam’s Market. Mr. Jaru commented the sale <br />closed a month ago and he was now completing renovations on the site. <br /> <br />City Administrator Ericson reviewed several questions staff had asked of Mr. Jaru noting staff <br />had not received an answer from the applicant. The first question was, has the applicant applied <br />for a tobacco license anywhere else. Mr. Jaru reported he had applied for a tobacco license in <br />Maplewood, which was denied. City Administrator Ericson reported the City of Maplewood has <br />no record of a tobacco license being requested by Mr. Jaru. <br /> <br />Mayor Flaherty questioned who regulated the sale of tobacco. City Attorney Riggs reported the <br />State and Federal government regulated the sale of tobacco. <br /> <br />City Administrator Ericson inquired if Mr. Jaru had applied for a tobacco license with the City of <br />Faribault. Mr. Jaru explained he had quite some time ago but the application was filled out <br />incorrectly. He was continuing to work on this application with the assistance of an attorney. <br /> <br />City Attorney Riggs further discussed the applications that were filled out for both Mounds View <br />and Faribault, along with the inconsistencies. He noted applications for tobacco permits are to be <br />filled out truthfully, which had not been the case for this applicant.
