Mounds View City Council September 14, 2015
Regular Meeting Page 3

C. Resolution 8455, Accepting Donation from Bethlehem Baptist Church and
Authorizing Distribution of Funds.

City Administrator Ericson explained that Bethlehem Baptist Church has been making donations
to the City of Mounds View for the past 10 years. These donations were used each year to assist
the City in funding programs and projects that were not covered by the City’s budget. He
reported that Bethlehem Baptist has made a donation in the amount of $15,542.50, which would
be used for Silver View Park restroom facilities, YMCA Safe After School for Youth Programs,
Festival in the Park, the Community Resource Center and for splash pad amenities. Staff
recommended the Council accept the donation and authorize distribution of funds.

Mayor Flaherty asked if the splash pad amenities should be funded when this item has not been
considered by the City Council. City Administrator Ericson commented that the funds would be
reprogrammed based on the needs of the City, in consultation with the Church.

MOTION/SECOND: Gunn/Mueller. Resolution 8454, Approving a Limited Use Agreement and an Assignment of
a Limited Use Agreement for 8160 Red Oak Court.

City Administrator Ericson stated in 1989 the City entered into an agreement with the Krigs
regarding the limited use of an easement area for a swimming pool at 8160 Red Oak Court. He
indicated the yard had a drainage easement that straddled the property line. He explained the
agreement was put into place to protect the City in the event the drainage easement were to fill
with water. He noted that the property owner was looking to sell the property and a new limited
use agreement was necessary in order to close and transfer the property. Staff recommended the
Council approve and assign a limited use agreement for the property at 8160 Red Oak Court.

Council Member Mueller asked if the City has had any problems with the easement area flooding
in the past 25 years. City Administrator Ericson reported there have not been any issues.

MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 8454,
Approving a Limited Use Agreement and an Assignment of a Limited Use Agreement for 8160
Red Oak Court.

Ayes – 5 Nays – 0 Motion carried.

D.
