Item No: 7D <br />Meeting Date: September 9, 2013 <br />Type of Business: Council Business <br />Administrator Review: <br />City of Mounds View Staff Report <br />Ak5- <br />To: Honorable Mayor and City Council <br />From: Thomas Stepaniak, Housing/Code Enforcement Inspector <br />Item Title/Subject: Resolution 8149 Authorizing Abatement of Nuisance Code <br />Violations at 5200 Jeffery Drive <br />Introduction: <br />The property located at 5200 Jeffery Drive is in violation of the City's Nuisance Codes and <br />there is a history of such violations at this property. The property owner has been notified of <br />the violations and provided ample time and extensions to achieve compliance. Multiple <br />inspections and reinspections have shown little to no progress thus warranting a request for <br />abatement via City Council action. The property owner has been provided the required <br />notice for this meeting. <br />Background: <br />Code Review. Chapter 607 of the City Code defines and regulates nuisances. Section 607.02 <br />defines nuisances in their most general form as any act, substance, matter, emission or thing <br />which "creates a dangerous or unhealthy condition orwhich threatens the public peace, health, <br />safety or sanitary condition of the City or which is offensive or has a blighting influence on the <br />community." Section 607.03 Subdivision 3c prohibits the outside piling, storing or keeping of <br />old machinery, junk, furniture, household furnishings or appliances or component parts thereof, <br />rusting metal inoperable/unusable equipment, or other debris visible on private or public <br />property. Section 607.09 Subdivision 5 provides the opportunity to reach compliance by <br />abating items in violation of the requirements contained within Chapter 607. In cases where no <br />immediate threat to the public health and safety exists, the City Code allows for the abatement <br />of the property upon ten day notification to the responsible party or property owner. <br />Previous Enforcement Activity. A review of City records indicates that the property at 5200 <br />Jeffery Drive was issued a notice of violation on May 23, 2011, regarding an accumulation of <br />junk outside and a vehicle parked off an improved driveway. A second notice of violation was <br />issued on August 12, 2011, regarding unsanitary living conditions and accumulations of junk <br />and debris inside. Each of these notices cited violations of the Chapter 607 of the City Code <br />regarding exterior storage and Chapter 1005 of the International Property Maintenance Code <br />for unsanitary living conditions. In each of these cases the enforcement action was closed <br />when substantial compliance was obtained, meaning that minimum requirements had been <br />satisfied. There are additional violations at this property previous to 2011 which are not noted <br />herein. <br />
