10. After the application of HSIP Funds the City shall reimburse the County 100% of the <br />construction cost of the EVP. <br />11. After the application of HSIP Funds the City shall reimburse the County a prorated share of <br />the construction cost of mobilization, traffic control and erosion control supervisor. <br />12. The City shall reimburse the County 100% of the construction cost for painted signal poles <br />and bases. This was not included in the project bid and is included in Supplemental Agreement #1. <br />13. The City shall reimburse the County twelve percent (12%) of the construction costs (as <br />determined by the low bid) of the City participating items prior to the application of HSIP Funds in <br />accordance with the Ramsey County Public Works Cost Participation Policy as a construction <br />engineering fee. <br />14. The City shall reimburse the County twelve percent (12%) of the design cost (as determined <br />by the low bid) of the City participating items prior to the application of HSIP Funds in accordance <br />with the Ramsey County Public Works Cost Participation Policy as a design engineering fee. <br />15. All City utilities or facilities modified or added to those provisions presently made in the <br />plans and specifications may be incorporated in the construction contract by supplemental agreement <br />and shall be paid for as specified in the supplemental agreement. Design and construction <br />engineering fees will be paid according to paragraphs 13 and 14 above. <br />16. Quantity distributions identified above are shown in the Statement of Estimated Quantities in <br />the plans. Estimated costs are identified in the Engineer's Estimates. Actual costs shall be based on <br />the contractor's unit prices and the quantities constructed. <br />17. All liquidated damages assessed against the contractor in connection with the work <br />performed on the Project shall result in a credit shared by the City and the County in the same <br />proportion as their respective total share of construction costs to the total construction cost without <br />deduction for liquidated damages. <br />18. The City shall not assess or otherwise recover any portion of its cost for this Project through <br />levy on County -owned property. <br />19. The County shall, when a construction contract is proposed to be awarded, prepare a revised <br />estimate and cost participation breakdown based on construction contract unit prices and submit a <br />copy to the City. Upon concurrence to award a construction contract, the City agrees to advance to <br />the Treasurer of Ramsey County an amount equal to the City's total construction cost share. <br />20. Upon substantial completion of the work, the County shall prepare a revised estimate of the <br />cost participation breakdown based upon the contract unit prices and the actual units of work <br />estimated to have been performed and submit a copy to the City. The construction engineering costs <br />to be paid the County by the City shall be based on this estimated final construction cost.
