WHEREAS, the Project is also eligible for funding from County State Aid Highway Funds <br />as S.P. 062-610-003 (CSAR 10) and S.P 062-644-033 (CSAR 44) for reimbursement of County <br />costs and for reimbursement of City costs as S.P. 146-228-007 (Red Oats Drive); and <br />WHEREAS, plans for this Project, S.P. 062-610-003, S.P. 062-644-033and S.P. 146-228- <br />007, showing proposed traffic control system with Audible Pedestrian Stations ("APS"), Emergency <br />Vehicle Preemption ("EVP"), concrete walk and bituminous bike path for the improvement of <br />County Road 10 at the intersection of Silver Lake Road/Red Oak Drive within the limits of the City <br />as a Federally -assisted HSIP project have been presented to the City; and <br />WHEREAS, the County will take bids for the Project, prepare an abstract of bids and cost <br />participation summary, request the City's concurrence to award a contract, award a contract and pay <br />the contractor from HSIP Funds, CSAH Funds and MSA Funds identified for the Project. <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br />1. Prior to County award of a contract, the County shall first receive concurrence from the City <br />for award of the contract to the lowest responsible bidder. <br />2. Upon award of a construction contract the County shall perform or contract the performance <br />of the construction inspection including survey work. <br />3. All City -owned rights of way and easements within the limits of the Project for roads, <br />utilities and stormwater are hereby granted to the County for Project use during construction. <br />4. The County and the City shall participate in the construction costs and engineering fees in <br />accordance with the adopted Ramsey County Public Works Cost Participation Policy. <br />5. The estimated construction cost of items eligible for HSIP Funds is $387,383.51. Additional <br />construction costs will be paid in accordance with the Ramsey County Public Works Cost <br />Participation Policy. <br />6. Upon completion of the Project, the County shall own and maintain the storm sewer catch <br />basins and leads on County roads and the City shall own and maintain the storm sewer hunk lines <br />within the City. Laterals and drains servicing property within the City outside the road right of way <br />shall also be owned and maintained by the City. <br />7. The City and the County shall maintain the traffic signals in accordance with Ramsey <br />County/City of Mounds View Maintenance Agreement PW2013-08 for the intersection of County <br />Road 10 and Silver Lake Road/Red Oak Drive. <br />8. After the application of HSIP Funds, the City shall reimburse the County 25% of the <br />construction cost of the Traffic Control Signal System A. <br />9. After the application of HSIP Funds, the City shall reimburse the County 100% of the <br />construction cost for two of six APS needed for Signal System A. <br />
