I <br />Item No: 07M <br />Meeting Date: July 22, 2013 <br />Type of Business: Council Business <br />of Mounds View Staff <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: First Reading and Introduction of Ordinance 880, an <br />Ordinance Amending Title 500 to Include Licensing <br />Requirements for Donation Collection Bins <br />Introduction: <br />In 2007 and 2009, the City had been asked to consider allowing donation collection bins in <br />the community. Both times the City Council was disinclined to allow the donation bins due <br />to repeated problems with ones that had been located in the community without <br />permission. The bins were unsightly and often had donations and other accumulated junk <br />alongside them for extended periods of time. For reasons such as these, the bins were <br />considered a nuisance and in violation of the City Code. <br />Discussion: <br />The City Council has again been asked to reconsider its position concerning donation <br />collection bins. Bradley Berg, representing US'Again, a for-profit textile and small goods <br />recycler, spoke to the Council about the various licensing restrictions than can be adopted <br />to ensure proper maintenance and operation of such bins. Mr. Berg provided a copy of a <br />sample ordinance outlining some suggested language the City could consider. At the June <br />3, 2013, Work Session, the Council directed staff to draft suitable language for its <br />consideration. Ordinance 880 provides for operational restrictions that would be added to <br />Title 500 (Business License Regulations) of the City Code. If approved, bins would be <br />permitted on properties owned and operated as an educational, religious, non-commercial <br />charitable use. Items left outside the bin would be removed within 24 hour's notice or be <br />subject to penalties, including license revocation. An exemption is provided for bins <br />associated with temporary fund-raising activities. <br />Recommendation: <br />If the Council supports allowing donation collection bins in the community on a limited <br />basis, staff would recommend the Council review and consider the first reading and <br />introduction of Ordinance 880, an Ordinance creating a new Chapter 519 outlining the <br />licensing standards associated with Donation Collection Bins in the City.
