To Waive the Reading and Adopt Resolution 8143, <br />Authorizing Fire Inspection Services Agreement with the Spring Lake Fire Department. <br />Ayes — 5 Nays — 0 Motion carried. <br />A. Resolution 8141, Approving the Preliminary Levy and General Fund Budget. <br />Finance Director Beer explained that approval of the preliminary levy and general fund budget by <br />the Council was the first step in the budgeting process. He indicated once the levy was set, it <br />could not be increased, only lowered. He stated the Council has set a 3% levy for the coming <br />year, which would create an additional $125,000 to the City's general fund. He then discussed <br />the general fund budget and recommended approval of the preliminary levy and budget. <br />Mayor Flaherty commented the levy approved this evening was preliminary and may be <br />decreased by the time the budget was finalized in December. <br />MOTION/SECOND: Mueller/Meehlhause. Review of Tires N' More, 2832 County Road 10, Conditional Use Permit. <br />Planning Associate Heller stated that in August of 2012 the Council approved a conditional use <br />permit for Tires N' More to operate out of the old Pak Building, which is located at 2832 County <br />Road 10. Attached to this conditional use permit were several conditions, such as the installation <br />of a fence on the west property line, installation of a sprinkler system. However, an outstanding <br />issue remains in that the applicant was to install a new parking lot on the site by September 1, <br />2013. <br />Planning Associate Heller indicated there has been a disagreement between the applicant and <br />CVS as to how the parking lot should be completed given the fact there was a cross access <br />easements. She commented the property owner was not available this evening as he was dealing <br />with a family emergency out of the country. She explained the Council could suspend or revoke <br />the Conditional Use Permit. She requested the Council discuss this matter further and direct staff <br />on how to proceed. <br />Mayor Flaherty commented that the agreement between CVS and the previous property owner <br />was the concern at this time. It was his opinion that a large portion of the parking lot could have <br />been completed even though there was a small part of the property that remained in dispute. He <br />questioned if the new property owners had a plan for the parking lot. Planning Associate Heller <br />indicated there was a plan for the parking lot and CVS was not in agreement with the proposed <br />plan. <br />
