of Mounds View Staff <br />Item No: <br />Meeting Date: 12/09/2013 <br />Type of Business: Council <br />Business <br />Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Craig Swalchick <br />Housing and Code Enforcement Inspector <br />Item Title/Subject: Abatement of Exterior Nuisance Code Violations at 7895 <br />Eastwood Rd. <br />Introduction: <br />The property located at 7895 Eastwood Rd. is in violation of the City's Nuisance Codes and <br />there is a history of such violations at this property. The property owner has been notified <br />of the violations and provided ample time and extensions to achieve compliance. Multiple <br />inspections and re -inspections have shown little to no progress thus warranting a request <br />for abatement via City Council action. The property owner has been provided the required <br />notice for this meeting. <br />Background: <br />Code Review: Chapter 607 of the City Code defines and regulates nuisances. Section <br />607.02 defines nuisances in their most general form as any act, substance, matter, <br />emission or thing which "creates a dangerous or unhealthy condition or which threatens the <br />public peace, health, safety or sanitary condition of the City or which is offensive or has a <br />blighting influence on the community." Section 607.03 Subdivision 3c prohibits the outside <br />piling, storing or keeping of old machinery, junk , furniture, household furnishings or <br />appliances or component parts thereof, rusting metal inoperable/unusable equipment, or <br />other debris visible on private or public property. Section 607.06 Subd.1 prohibits the <br />"outside parking and storage on residentially zoned property of vehicles, materials or <br />equipment not customarily used for residential purposes." <br />Previous Enforcement Activity: A review of City records indicates that the property at 7895 <br />Eastwood Rd. and the property owner Ron Peterson has been issued numerous Notices <br />and Citations to correct similar code violations dating back to 1995. <br />In 1995 and 1996, letters were mailed to Ronald and Mary Peterson in regards to <br />"apparent municipal code violations" involving junk vehicles parked of an improved surface. <br />In June 2006, a Notice of Violation was written for having a "junk" van parked on the lawn <br />behind the garage. <br />In November of 2006, a notice of violation was written for having "junk" vehicles and <br />vehicles parked off an improved surface. <br />—) C <br />
